C on la entrada en vigor del Tratado de Lisboa, la Carta de Derechos Fundamentales adquiere eficacia jurídica, y se prevé la posibilidad de que la Unión Europea se adhiera al Convenio de Roma. En este trabajo pretendemos acercarnos a los antecedentes que han justificado una huída de la tutela de los derechos fundamentales de base jurisprudencial desarrollada por el Tribunal de Justicia hacia una formalización de la misma, a través de dos caminos: la formalización a través de una declaración de derechos que se ha concretado en la Carta de Derechos Fundamentales, y la adhesión al Convenio de Roma. Finalmente trataremos de esbozar las perspectivas que se abren en el horizonte constitucional de la Unión Europea, donde gozamos ya de un Tribunal de Justicia que ejercerá una función tan constitucional como la tutela de los derechos fundamentales, contenidos ya en una declaración con fuerza jurídica, cuya interpretación se vincula al Convenio de Roma.
With the entry into force of the Treaty of Lisbon, the Charter of Fundamental Rights of the European Union becomes binding, and provides the possibility that European Union accedes to the Rome Convention. In this research we try to approach the origin of the escape from the judicial protection of fundamental rights by the European Union Court, towards a formalization of it, through two ways: the formalization of a Fundamental Rights Charter, and the accession to the Rome Convention. Finally, we will revise the opportunities in the constitutional horizon in European Union, with a Court of Justice that must enjoy a constitutional function such as the protection of fundamental rights, now with the Charter, which interpretation is linked to the Convention of Rome.
