Existen escasos estudios que aborden la construcción del sistema judicial en la Guinea Española
como fuente para el estudio de las relaciones coloniales. El presente artículo propone analizar su
evolución y sus tensiones, así como la interpretación de algunos pleitos representativos de los
Tribunales de Demarcación entre 1938 y 1959. La justicia colonial de Guinea fue similar en
estructura a la que implementaron otras potencias, organizada a través de un modelo de dualismo
legal basado en la existencia de una justicia europea, bajo el ordenamiento peninsular, y de raza,
supuestamente sujeta al derecho consuetudinario. El proceso de institucionalización de este
modelo culminó en 1938, ya con la llegada del franquismo, cuando la acción colonial se
intensificó considerablemente. La investigación se centra fundamentalmente en este período y
sugiere que el sistema de Tribunales de Raza debe entenderse como el producto de un proceso
bidireccional (evidentemente desigual) entre colonizados y colonizadores; es decir, como un
espacio donde las estrategias de asimilación y disciplina social del Estado interactúan con las
resistencias y la apropiación local de estos dispositivos.
There are few studies that treat the construction of the judicial system in Spanish Guinea as a source for the study of colonial relations. The current text proposes to narrate its evolution and tensions, as well as interpreting some representative lawsuits of the Tribunals of Demarcation between 1938 and 1959. Guinea’s colonial justice was similar in structure to that implemented by other powers in that it was organized through a model of legal dualism based on the existence of European justice, under the Peninsular system, and racial justice, supposedly subject to customary law. The process of the institutionalisation of this model culminated in 1938, with the arrival of Franco’s regime, when colonial action intensified considerably. This article focuses primarily on this period and suggests that the system of Race Tribunals should be understood as the product of a two-way process (evidently unequal) between the colonized and colonizers; that is, a space where the state’s strategies of assimilation and social discipline interacted with resistance and the local appropriation of these devices.
