Resumen
Las insolvencias punibles es una de las figuras más versátiles del Código Penal, ya que es posible encontrarla en distintos ámbitos, así como relacionada con otros delitos económicos, que suele ser lo más habitual. En este trabajo se verán las modificaciones normativas sufridas en los últimos tiempos, que son bastantes e importantes, como no podía ser de otro modo, para adecuarse a los cambios experimentados en la sociedad. También, el tratamiento que la jurisprudencia le ha dado en los últimos años con la dificultad añadida de todos los cambios normativos. Y la importante opinión de la doctrina al respecto. Para terminar, se incluye la figura del decomiso penal, que se erige en un importante instrumento judicial, para asegurar el bien jurídico protegido en estos delitos que no es otro que el crédito del(los) acreedor(es) frente al(los) deudor(es). Por eso, es importante ver la evolución de la legislación tanto en las insolvencias punibles como en el decomiso penal. Como lo es también, para el propósito de este trabajo, analizar el tratamiento tanto doctrinal como jurisprudencial más reciente en aras a ver la implicación que hay entre las dos figuras.
Punishable insolvency is one of the most versatile figures of the Criminal Code, since it is possible to find it in different areas, as well as related to other economic crimes, which is usually the most common. In this work, the normative modifications suffered in recent times will be seen, which are enough and important, as it could not be otherwise, to adapt to the changes experienced in society. Also, the treatment that jurisprudence has given it in recent years with the added difficulty of all the regulatory changes. And the important opinion of the doctrine in this regard. Finally, the figure of criminal confiscation is included, which stands as an important judicial instrument, to ensure the legal right protected in these crimes, which is none other than the credit of the creditor(s) against the debtor(s). For this reason, it is important to see the evolution of the legislation both in punishable insolvencies and in criminal confiscation. As it is also, for the purpose of this work, to analyze the most recent doctrinal and jurisprudential treatment in order to see the implication between the two figures.
