El objeto de este trabajo es estudiar la jurisprudencia de nuestro Tribunal Constitucional que podemos considerar de interés para valorar los eventuales defectos en el procedimiento legislativo preparlamentario. La cuestión general que se plantea es la de determinar qué trámites del procedimiento legislativo son requisitos para la perfección del acto jurídico legislativo. Según nuestro Tribunal Constitucional “sólo podrá suponer un vicio de constitucionalidad formal de la ley si, [...], los fallos en la conformación de esa voluntad gubernamental implican que el Congreso de los Diputados, o el Senado en aquellos supuestos en que sea Cámara de primera lectura, carezcan de los elementos necesarios para pronunciarse sobre esos proyectos” (STC 238/2012, de 13 de diciembre, FJ 3).
The purpose of this paper is to study the jurisprudence of our Constitutional Court that we can consider of interest to assess any defects in the preparatory legislative procedure. The general question that arises is to determine which procedures of the legislative procedure are requisites for the perfection of the legal legislative act. According to our Constitutional Court "it can only be a defect of formal constitutionality of the law if, [...], the failures in the conformation of that governmental will imply that the Congress of Deputies, or the Senate in those cases in which it is Chamber of first reading, lack the necessary elements to pronounce on those projects "(STC 238/2012, December 13th, FJ 3).
