dc.description.abstractLa Ley 8/2021 ha reforzado la figura del notario como prestador de apoyo institucional a la persona con discapacidad y como autoridad que vela por la existencia de salvaguardias que impidan abuso e influencia debida y que, a su vez, garanticen el respeto a la voluntad y preferencias de la persona con discapacidad o en su caso, su interés superior. Entre todas sus funciones de apoyo y asesoramiento, el juicio de capacidad se ha convertido en un juicio de discernimiento, subjetivo y circunstancial al caso concreto que se debe adaptar ante la existencia de apoyos. El actuar del notario variará según que las personas se hayan adaptado o no a la reforma o tengan medidas de apoyo voluntarias, informales o judiciales.es
dc.description.abstractLaw 8/2021 has reinforced the figure of the notary as a provider of institutional support to people with disabilities and as an authority that ensures the existence of safeguards that prevent abuse and due influence and that, in turn, guarantee respect for the will and preferences of the person with disabilities or, where appropriate, their best interests. Among all its support and advisory functions, the judgment of capacity has become a judgment of discernment, subjective and circumstantial to the specific case that must be adapted to the existence of support. The act of the notary will vary depending on whether or not people have adapted to the reform or have voluntary, informal or judicial support measures.en
