El trabajo parte de la regulación constitucional del derecho a la protección a la salud y analiza el desarrollo jurisprudencial en torno al mismo por parte del Tribunal Constitucional durante estos casi cuarenta años. Explica que el derecho a la protección a la salud aparece regulado como un principio rector y no como un derecho fundamental. Ahora bien, la protección a la salud exige el reconocimiento de derechos subjetivos y no solamente de principios rectores. Un sector de la doctrina científica considera que por este motivo debe reconocerse constitucionalmente un derecho a la salud distinto del principio rector de la protección de la salud. Nuestro Tribunal Constitucional, hasta la fecha, ha protegido esas facetas que suponen derechos subjetivos poniendo en conexión el derecho a la protección de la salud con derechos fundamentales protegidos pro recurso de amparo ante el Tribunal constitucional como el derecho a la vida, el derecho a la intimidad o el derecho a la tutela judicial efectiva.
The work starts from the constitutional regulation of the right to health protection and analyzes the jurisprudential development around it by the Constitutional Court during these forty years. It explains that the right to health protection is regulated as a guiding principle, and not as a fundamental right. However, the health protection requires the recognition of fundamental rights and not only of guiding principles. One sector of Spanish scientific doctrine considers that for this reason a right to health should be constitutionally recognized as distinct from the guiding principle of health protection. Our Constitutional Court, up to now, has protected those aspects that imply fundamental rights establishing the connection between the right to the protection of health and fundamental rights protected by the amparo appeal before the Constitutional Court as the right to life, the right to privacy or the right to effective judicial protection.
