Resumen
Auspiciada por su simplicidad e instantaneidad y revestida de gratuidad, WhatsApp es una utility que ha transformado la manera en que se mantienen conversaciones. Es un hecho irrefutable que el uso generalizado de esta aplicación de mensajería se ha convertido en un adalid de la comunicación. Pero la universalización de este servicio desafía constantemente el sector normativo que se ocupa del ámbito comunicativo y es razonable preguntarse si lo desborda. En este artículo se analizan las principales cuestiones controvertidas que se plantean en torno a la salvaguarda del derecho al honor en su interacción con el ámbito comunicativo y se identifican las respuestas que brinda el ordenamiento jurídico español desde una perspectiva académico-profesional, con el objeto de perfilar el alcance y la viabilidad de su protección.
Boosted by its simplicity and instantaneousness and incentived on a free-of-charge basis, WhatsApp is a utility that has transformed the way in which conversations are held. It is an irrefutable fact that the widespread use of this messaging application has become a key driver of the Communications sector. But the universalization of this service constantly challenges the regulatory policies of the aforementioned sector and it is reasonable to ask whether it exceeds it. This messaging platform is a service provider and, as such, remains subject to its own regulation. However, this fact do not necessarily implies that it lacks applicable regulation. There are five rights involved in WhatsApp conversations (honor, privacy, image, secrecy of communications and data protection -the so-called personality rights-). This article analyzes the main controversial issues that arise around the safeguarding of the right to honor in its interaction with the communicative field and identifies the responses provided by the Spanish legal system from an academic-professional perspective, with the aim of outline the scope and feasibility of their protection.
