Resumen
El artículo 24 de la Ley 19/2013, de 9 de diciembre, de transparencia, ac-ceso a la información pública y buen gobierno (LTAIBG), establecía la posibilidad de formular reclamaciones ante denegaciones expresas o presuntas respecto a solicitudes amparadas en el derecho de acceso a la información. Para ello se creaba en el ámbito del Estado el Consejo de la Transparencia y Buen Gobierno (CTBG), mientras que las comunidades autónomas podían optar por atribuir las funciones al CTBG mediante convenio o asumirlas a través de organismos autonómicos existentes o nuevos. Esta contribución tiene por objeto la comparación sistemática de las características que han adoptado dichos organismos en su diseño para asegurar su independencia en el ejercicio de sus funciones. Para ello se realiza un análisis comparado de la normativa estatal y autonómica respecto a elementos como su régimen jurídico, funciones, organización interna y espe-cialmente sobre su composición. Del análisis realizado se extrae que en la mayoría de los casos hay elementos tendentes a asegurar su independencia, pero precisamente los órganos decisorios respecto a las reclamaciones dentro de cada organismo son los que en mayor medida carecen de características en su diseño que la garanticen.
The article 24 of the Law 19/2013 of 9 December, on Transparency, Access to Public Information and Good Governance (LTAIBG), established the pos-sibility of formulating complaints with regard to express or presumed rejec-tions related to requests protected by the right to access public information. At the national level, the Council for Transparency and Good Governance (CTBG) was created, while Autonomous Communities could choose to as-sign the role to CTBG signing an agreement, or to assign the role to other existing autonomous organisms or to a new one. This contribution aims the systematic comparison of the features adopted by the referred organisms in order to ensure their independence in the com-plaint resolution process. For this purpose, a comparative analysis of the national and autonomic regulations referred to elements such as their legal framework, functions, internal organization and especially their composi-tion, is carried out. The analysis shows that, in most cases, there are elements with a tendency to ensure their independence, but the complaints decision-making bodies placed in each organism are the ones that lack the attributes in their design to ensure their independence.
