Resumen
La presente contribución tiene por objeto la estructura de la propuesta de Reglamento sobre la protección de adultos en la Unión Europea; esto es, competencia judicial internacional, ley aplicable, reconocimiento y ejecución de las medidas y la cooperación en materia de protección de adultos. Para ello, se tiene en cuenta los motivos que justifican dicha propuesta, así como la finalidad del instrumento. Se sostiene que la divergencia existente entre las normas internas de los Estados miembros en materia de protección de adultos necesitados de protección incide en una vulneración de sus Derechos fundamentales, reconociéndose la urgente necesidad de un Reglamento que armonice las normas de Derecho Internacional Privado sobre protección de adultos en la Unión Europea.
The purpose of this contribution is the structure of the proposed Regulation on the protection of adults in the European Union; that is, international jurisdiction, applicable law, recognition and enforcement and recognition of measures and cooperation in matters of adult protection. To do this, the reasons that justify said proposal are taken into account, as well as the purpose of the instrument. It is argued that the existing divergence between the internal rules of the Member States regarding the protection of adults in need of protection affects a violation of their fundamental rights, recognizing the urgent need for a Regulation that harmonizes the rules of Private International Law on the protection of adults in the European Union
