Esta modalidad delictiva aparece tipificada en el artículo 380 del Código Penal, y el presente estudio tratará de ofrecer algunas propuestas de mejora en su redacción, sugiriendo una reforma parcial del precepto en aras de alcanzar la eficacia de los principios que imperan en el Derecho punitivo, y que se encuentran presentes en la protección penal de la seguridad vial.This paper aims to analyse the components of the criminal offence of manifestly reckless driving from a both theoretical and practical perspectives, within the realm of Penal Law by means of the most recent jurisprudence and doctrinal interpretation.
