This crisis in the humanities has a strong relationship with cultural changes. During the 20th century the concept of culture has been revised for several times, especially during the sixties, but it has not been until the book of Lyotard Postmodernity when “globalization” has started to play an important role in this area. The key points of the current crisis of the humanities are consequence of a strong criticism (which comes from the period of Descartes and Kant, who settled the basis of this crisis), of the lack of authority, and of the common culture. The solution has to be searched in the creation of new reactions towards the power of these pressure groups. In this paper, we will analyze the repercussions of all these factors in the Spanish humanities, and we will study the solutions which are being offered to organize that reaction, such as the creation of literary prizes, the foundation of philosophical communities, the defence of human rights and law studies, the development of cultural inheritance, the increase of social conscience (non-profit organizations), the proliferation of activities related with the Arts, and religious development. All these strategies have three common aims: to flee of authoritarian or imposed solutions, to look for concrete and positive expressions, and to boost concrete and local cultural projects. Es evidente que, a diferencia del texto constitucional anterior, se menciona expresamente la vida fetal y embrionaria, al igual que de modo también expreso se preceptúa que gozará de protección desde el momento de la concepción. Esta nueva regulación constitucional estaría para algunos, no estrictamente ampliando los titulares del derecho a la vida, pero sí al menos extendiendo el manto protector de la Constitución a la vida fetal y embrionaria desde su comienzo, lo que tendría por consecuencia excluir de plano la posibilidad de abortar legalmente en cualquier supuesto a voluntad de la mujer, suponiendo ello una ausencia de garantía para otros derechos fundamentales en juego de la madre.
La controversia en torno al art. II no sólo ha estado centrada en el supuesto enfoque más restrictivo del nuevo texto constitucional hacia el aborto, sino que se ha extendido a la propia concepción de derecho de la dignidad humana, que para cierta doctrina ha recibido una configuración distinta a la concepción predominante en el derecho europeo. Under Article II of Hungarian Basic Law «Human dignity shall be inviolable. Every human being shall have the right to life and human dignity; embryonic and foetal life shall be subject to protection from the moment of conception». It is evident that, unlike the previous Constitution, the Basic Law expressly mentions the fetal and embryonic life, as also expressly stipulates that it shall be protected from the moment of conception. This new constitutional provision would be for some scholars, not strictly expanding the holders of the right to life, but at least extending the protective cloak of the Constitution to fetal and embryonic life from its beginning, which would effectively exclude outright the possibility of legal abortion at discretion of woman in any event, implying an absence of constitutional guarantee for other mother’s fundamental rights at stake.
The controversy about art. iniciativa popular caracteriza el régimen suizo en línea con su apuesta
por la utilización de mecanismos de democracia directa. Sin embargo,
la estrechez de los límites constitucionales impuestos a estas iniciativas
puede dar lugar a serias contradicciones entre el orden jurídico-político
interno y los compromisos internacionales asumidos por el país, lo que
resulta particularmente grave en lo que se refiere a los derechos humanos.
Así, la aprobación en 2009 de una nueva disposición constitucional
que prohíbe taxativamente la construcción de minaretes en la Federación
Helvética supone una fuente de conflictos normativos que parte
desde la posible violación de la libertad religiosa o el derecho a la no
discriminación, protegidos por las principales normas internacionales de
derechos humanos. En las condiciones actuales, hallar una solución estable
a esta suerte de contradicciones normativas resulta complicado, toda vez que la cultura política suiza es reacia tanto a ensanchar los límites de
la soberanía popular como a recibir correcciones de jueces extranjeros.
De este modo, se presentan por un lado una serie de problemas o dificultades
de orden jurídico y por otra parte, cuestiones de naturaleza
política. Entre las primeras, debe analizarse en primer lugar si una prohibición
de la construcción de minaretes en sede constitucional entraña
una violación de los derechos a la libertad religiosa o a la no discriminación
tal y como se recogen en normas internacionales, especialmente
el Convenio Europeo de Derechos Humanos. Respecto a este mismo
punto, cabe estudiar el acceso al Tribunal Europeo de Derechos Humanos
como garante de dicho convenio contra la disposición constitucional
suiza o las decisiones tomadas en aplicación de la misma. En segundo
lugar, es preciso estudiar los conflictos que pueden producirse en el
orden suizo entre normas constitucionales y normas internacionales, así
como plantear posibles soluciones a las mismas. Por lo que se refiere a las cuestiones de orden político, su análisis
deviene relevante para contextualizar adecuadamente las dificultades
jurídicas explicadas. En primera instancia, es conveniente estudiar el
significado del referéndum planteado en 2009 respecto de la construcción
de nuevos minaretes en un país que apenas cuenta con cuatro de
estas construcciones. La cultura política tradicional de Suiza ayuda en
este sentido a entender las dificultades de articulación entre la democracia
directa y un posible control jurídico internacional, así como la
relativa ausencia de controles internos, en sede judicial o parlamentaria
de las iniciativas populares. El peculiar modelo suizo se presenta
así problemático en un contexto de armonización europea sobre la
base de un marco común de protección de derechos humanos.
El análisis conduce a resaltar la necesidad de ensanchar los filtros de
admisión de iniciativas populares, reinterpretando el concepto de
normas imperativas de Derecho internacional a fin de incluir en las
mismas los elementos de los derechos humanos que pueden constituir
hoy en día parte de un acervo europeo común.The option to approve by referendum constitutional amendments proposed
by popular initiatives is one of the characteristic of the Swiss regime,
which fosters the use of direct democracy mechanisms. However,
the narrowness of the constitutional limits to this kind of initiatives
may open the door to serious contradictions between the domestic legal
order and those international commitments undertaken by the country,
being this particularly relevant in respect of human rights protection.
Thus, the approval in 2009 of a new constitutional clause banning the construction of minarets in the Helvetic Federation entails a set of legal
questions, starting from the possible violation of the religious freedom
or the right not to be discriminated against, both protected by the
highest international norms on human rights. Within the current conditions,
finding an stable solution to these legal inconsistencies seems
difficult, being the Swiss political culture reluctant to enlarge the limits
of the popular sovereignty and to receive mandates from foreign judges.
In this way, we face on the one hand problems or difficulties in the legal
field and, on the other hand, questions of a political nature. Among
the former, it must be firstly analysed whether the ban for construction
of new minarets at the Constitution entails per se a violation freedom of
religion or the right not to be discriminated against, in the way these
rights are understood in the main international human rights instrument,
such as the European Convention of Human Rights. In relation
to the same point, it is also possible to study the access to the European
Court of Human Rights as legal guarantee of the aforementioned treaty,
appealing against the constitutional clause or against the possible
decisions taken in its implementation. Secondly, it is necessary to reflect
about the conflicts that may arise at the Swiss legal order between
constitutional dispositions and international norms, as well as look for
possible solutions to these inconsistencies. As for the political aspects, their analysis becomes relevant to rightly
contextualize the aforementioned legal difficulties. Firstly, it is
necessary to reflect about the real meaning of the 2009 referendum
in a country where no more than four minarets can be found. The
traditional political culture of Switzerland helps in this respect to
understand the difficulties to put together direct democracy and
international legal controls, or the absence of parliament or judicial
domestic controls for popular initiatives. The peculiar Swiss model is
thus a problematic one in a context of European harmonisation on the
basis of a common framework of human rights protection.
The analysis brings us to underline the need to enlarge the admission
filters of the popular initiatives, adopting a new interpretation of the
concept of peremptory norms of international law, with the aim of
including in it those elements of human rights that constitute today

Si en la década de los 80 el conflicto giró alrededor de la articulación de la educación pública y la de iniciativa social (y la correspondiente financiación de este tipo de educación) y en los debates entre pluralismo interno y pluralismo externo en la enseñanza, en los últimos años ha emergido el disenso en torno a qué debe entender por educación. En este sentido, ha cobrado actualidad el debate en torno al ideario educativo constitucional.
En el presente artículo se examina la existencia del ideario educativo constitucional y el alcance del mismo, a partir de su proyección en la resolución de conflictos jurídicos que en esta materia han tenido lugar en los últimos años.
Así, en primer lugar se analiza la cuestión de la educación en casa, y su interrelación con el mencionado ideario educativo constitucional, al objeto de determinar cuál es la finalidad de la educación.
En segundo término, y dado que el Tribunal Constitucional considera que la educación tiene una finalidad de integración social que va más allá de la transmisión de conocimientos, se analiza esta vertiente cívica de la educación, a partir de la polémica generada por la introducción en el currículo de la materia «Educación para la ciudadanía». En tercer lugar, y en atención a la relación entre ideología constitucional y enseñanza institucional, se considera la legitimidad de los colegios especializados por sexo.
Finalmente, a partir de las consideraciones efectuadas en los casos citados, se propone una concepción restrictiva del ideario educativo constitucional, en orden a preservar el pluralismo político y la distinción entre Estado y sociedad, clave en una sociedad democrática.The regulation of the educational rights has proven to be one of the most troubled of the Spanish constitutional experience. If in the 80s the conflict revolved around the articulation of public education and social initiative (and funding of such education) and discussions between internal and external pluralism in education, in recent years has emerged dissent about what is meant by education. In this sense, the debate has gained currency in the constitutional educational ideology.
In this paper is examined the existence and scope of the educational ideology of the Constitution, from its projection in the resolution of legal disputes in this area that have taken place in recent years.
Firstly, is analyzed the issue of home schooling, and its relationship with the above mentioned educational ideology of the Constitution, in order to determine what is the purpose of education.
Secondly, and given that the Constitutional Court considers that education has a purpose of social integration that goes beyond the transmission of knowledge, civic aspect of education is analyzed, from the controversy generated by the introduction into the curriculum of the subject «Education for Citizenship». Third, and in view of the constitutional relationship between ideology and institutional education is considered the legitimacy of the schools specialized by sex.

It compares quantitatively and qualitatively the electoral manifestos of four radical right parties —Vox, RN, UKIP, and Brexit Party—, and shows that borders are basic factors in the process of decontestation of “the people” and construction of exclusion-inclusion narratives. Likewise, this analysis exemplifies how (re)bordering claims are usually justified and articulated via populist discursive elements such as antagonism, morality, idealization of society, popular sovereignty and personalistic leadership. This article demonstrates that the border can become a method to study populism and vice versa and that crossfertilization between the borders and populism literatures is desirable. crítico de los supuestos conceptuales del
llamado Manifiesto de los Persas, obra
fundamental para entender la reacción
absolutista que siguió a la revolución
liberal de Cádiz y sustento doctrinal del
golpe del 4 de mayo de 1814. Veremos
las peculiaridades del absolutismo de tipo
católico respecto del hobbesiano y la
importancia que tiene para la reacción la
utilización ideológica del derecho histórico
en la impugnación de la obra
constitucional. Asimismo, y en la
sospecha permanente ante el engaño de
los políticos, el indefenso pueblo quedará
a salvo refugiado en el padre y soberano
católico. Esa concepción patriarcalista,
esencial a la restauración fernandina, se
verá completada por una visión
providencial y redentora del monarca, lo
que determinará buena parte del sentido
de la política del sexenio.This article tries to make a critical analysis
of the conceptual assumptions of the
called «Manifiesto de los Persas», the
work fundamental to understand the
absolutist reaction that it followed the
liberal revolution of Cadiz and doctrinal
sustenance of the blow of the 4th of May
1814. We will see the peculiarities of
absolutism of catholic type respect to the
hobbesian and the importance that the
ideological use of the historical right in the
opposition of the constitutional work has
for the reaction. Also, and in the
permanent suspicion before the deceit of
the politicians, the defenseless people will
be out of danger refugee in the father and
catholic sovereign. That patriarchalist
conception, essential to the fernandine
restoration, will be completed by a
providencial and redentor vision of the
monarch, which will determine good part

In this paper we have considered the concept of disability as part of diversity and, above all, as a fundamental subject of human rights and justice, which has allowed us to include the collective of PWD among the stakeholders of companies. The research on the incorporation of disability as an integral part of the policies of Corporate Social Responsibility (CSR) in companies is very recent, although the term Corporate Social Responsibility and Disability is already used. The main objective of this paper is to analyze the commitment with PWD of Spanish companies considered socially responsible by the sustainability indices used. We have included in four large dimensions (Stakeholders, Visibility, Human Resources and Accessibility) the indicators that have allowed us to analyze the information on PWD published by these companies in their sustainability reports or similar documents accessible through their websites. The results suggest that the companies are more concerned about improving their image towards the exterior than for the commitment with their own employees, which is consistent with the dimension Visibility being where the companies carry out more actions in favor of PWD.0692<a class="citation_author_name" title="Navegar por nombre de Autor de Segovia San Juan, A. una mínima importancia a la educación
en el marco de los derechos y las políticas sociales
europeas, aumentando su peso paulatinamente,
como comprobaremos en la
propia evolución de la Educación Permanente
en la UE, desarrollo que hemos dividido en
cuatro etapas fundamentales.
Así, desde la proclamación del Año Europeo
de la Educación y la Formación Permanentes
en 1996, en el que se fomentó en el seno de
la UE el concepto de aprendizaje durante toda
la vida, la Educación Permanente ha cambiado
radicalmente en Europa hacia una
nueva realidad que se ha dado en llamar “Espacio
Europeo de Aprendizaje para toda la
vida”, que analizamos en profundidad a través
del análisis de la legislación y programas
educativos existentes en la UE.In its early years, the European Union (EU)
granted a minimal importance to education
in the framework of rights and social policies
in Europe, increasing its weight gradually, as
we will check on the evolution of Continuing
Education in EU development which we have
divided into four basic stages.
So we will check how, since the proclamation
of the European Year of Education and Training
Standing in 1996, which fostered within
the EU the concept of lifelong learning, Continuing
Education has changed dramatically
in Europe towards a new reality that has been
termed a "European Area Learning for Life"
which analyzed in depth through the analysis
of legislation and educational programs existing
