of the Charter, the right to a fair trial. It is not a new contribution of
the Charter but a guarantee which has been provided by EU Law for
decades. It first appeared as a procedural right, was later recognized
as a general principle of the EU and was finally embodied in the
Charter. Consequently this work recalls that process of recognition,
paying special attention to the judicial remedies provided by EU law
and to some specific rules of secondary —competition— law which
affect the context on which the right to a fair trial is developed. The
article concludes by underlining, on the one hand, the improvements
on the right to a fair trial brought about by this legal process and, on
the other hand, a few gaps on the issue which are neither recent nor
consistent with the effectiveness and completeness of such right as it
is required by the Rule of Law tradition.Este artículo se centra en uno de los derechos previstos por el artículo 47
de la Carta Europea de Derechos, el derecho a un juicio justo. No es una nueva aportación de la Carta, pues se trata de una garantía de que
ha sido proporcionada por la legislación de la UE durante décadas.
Primero apareció como un derecho procesal, más tarde fue reconocido
como un principio general de la Unión Europea y finalmente fue
incorporado a la Carta. Por lo tanto, este trabajo recuerda ese proceso
de reconocimiento, prestando especial atención a los recursos judiciales
de derecho de la UE y a algunas normas específicas de derecho
derivado que afectan al contexto en que se desarrolla el derecho a un
juicio justo. El artículo concluye subrayando, por un lado, las mejoras
sobre el derecho a un juicio justo provocado por este proceso legal y,
por otra parte, algunas lagunas en este ámbito que son ni recientes
ni compatibles con la eficacia y la integridad de ese derecho, como lo

El catolicismo político tuvo un papel muy relevante en el proceso de modernización de las derechas españolas y portuguesas de la primera posguerra. Salazar y Franco presentaron los regímenes que ellos mismos construyeron y sobre los que gobernaron como siendo intrínsicamente católicos, y los católicos fueron actores principales de las coaliciones políticas y sociales que sostuvieron ambos dictadores. En su lucha contra la Primera República Portuguesa (1910-26) y la Segunda República Española (1931-39), las fuerzas políticas conservadoras y de extrema derecha concedieron un papel estratégico a los católicos politicamente organizados en lo que se refiere a la movilización de las masas y en la constitución de un amplia coalición que pudiese crear una alternativa sólida a la democracia liberal y a un movimento obrero cada día más fuerte. En los años centrales de la «Era del Fascismo», las derechas católicas ibéricas y la jerarquía de la Iglesia sancionaron un giro muy notorio hacia una lectura crecientemente fascistizada del contexto político europeo posterior a la Revolución Soviética.The crisis of the Iberian liberal systems in inter-war Europe is especially interesting to study because of the specific role of the Catholic component of both the sustaining political coalition and the identity of these two of the European 20th century authoritarian regimes. Political Catholicism was a major actor in the modernisation process of Spanish and Portuguese post-World War I rightwing movements. Salazar and Franco presented the regimes they built up and ruled upon as being intrinsically catholic, and Catholics were major partners in the political and social coalitions supporting both dictators. In their struggle against the Portuguese First Republic (1910-26) and the Spanish Second Republic (1931-39), conservative and extreme-right forces conceded to politically organised Catholics a strategic role in mass mobilisation and in assembling a wide coalition who could create a solid alternative to Liberal-Democracy and a growingly strong working-class movement. imprenta durante la primera experiencia constitucional en España. En el
examen del contexto de su reconocimiento se observa que la libertad de
imprenta se alcanzó antes de facto que de iure, circunstancia que facilitó
enormemente la libre circulación de todo tipo de escritos y que, asimismo,
coadyuvó al intercambio de ideas sobre el nuevo modelo de Estado.
Del estudio de las principales razones que motivaron la aprobación
del Decreto de imprenta de 1810 se desprende que las Cortes no
concibieron la libertad de imprenta exclusivamente como un derecho
individual que posibilitaba el libre desarrollo de la personalidad sino
que, además, se trataba de un derecho llamado a desempeñar importantes
funciones en el nuevo modelo político que deseaban implantar.
Idea que corrobora el análisis del proceso constituyente y del funcionamiento
de las instituciones creadas por la Constitución de 1812.
Concretamente, en referencia al proceso constituyente, se observa que
con carácter previo a la aprobación de una Constitución digna de ser
calificada como racional-normativa, fue imprescindible reconocer y
garantizar la libertad de imprenta. Y, en relación al funcionamiento
de las nuevas instituciones liberales, la citada libertad pública era del
todo necesaria, dado que, entre otras cuestiones, posibilitó a los españoles
fiscalizar y controlar el ejercicio del poder político.Present contribution studies the role that freedom of the press fulfilled
during the first constitutional experience in Spain. Within the
study of the context of its recognition it is observed that Freedom of
the press was achieved before de facto rather than de iure. This circumstance
made possible the circulation of all kind of documents which
also contributed to the exchange of ideas about the new State model.
From the study of the main reasons that motivated the approval of the
Press Decree of 1810 can be inferred that Courts did not only conceive
Freedom of the press as a mere individual right that enabled the
free development of personality, but also as a right that was expected
to fulfill important functions in the new political model that was intended
to be established. This idea is corroborated by the analysis of
the constituent process and the work environment of the institutions
created in the 1812 Constitution. With reference to the constituent
process, it is observed that previous to the approval of a Constitution
that could be called as rational- regulatory, it was compulsory
to recognize and guarantee the Freedom of the press. Finally, and
related to the work environment of the new liberal institutions, the
aforementioned public liberty was entirely necessary as it allowed the
citizens the supervision and control of the political power’s exercise

of the multiculturalism and plurality which is the basis of today’s
Europe. That is why the EU institutions have adopted various regulations
aimed at the promotion, preservation and protection of the languages
used by EU citizens, especially those of so-called regional or
minority groups. Though implementing this protection is delegated
to Member States themselves, the EU authorities for their part have
also taken decisive steps in order to ensure the continued health of the
languages that enrich the idiosyncrasies of both the Member States
and of the Union itself. While the protection of minorities at a Community
level was not an initial priority at the outset of the EU given
the greater importance of economic and political considerations.
However, with the entry into force of the Treaty of Maastricht there
has been a significant change in this respect; the recognition of minority
rights has now become a reality. This recognition is now given
due consideration as evidenced by the provisions of both the Charter
of Fundamental Rights and the Treaty of Lisbon. This paper has outlined
the progress that has been made in the protection of linguistic
minorities at the EU community level, without forgetting the work
within other extra-Eu institutions, as it is the case of the Council of
Europe, among others, without whose work the levels of protection of
existing minority languages not have reached today.La diversidad lingüística existente en el seno de la Unión Europea
supone una expresión de la multiculturalidad y de la pluralidad
que no es sino la base de la Europa actual. Es por ello que desde las
instituciones han sido adoptadas distintas normativas tendentes a
la promoción, conservación y protección de la lenguas utilizadas
por los ciudadanos comunitarios, especialmente de las denominadas
regionales o minoritarias, ya que si bien es verdad, que esta protección
ha de ser llevada a cabo por los propios Estados miembros, las
autoridades comunitarias han dado pasos decisivos en aras a garantizar
la no desaparición de las lenguas que enriquecen la idiosincrasia
tanto de los Estados como de la propia Unión. La protección en el
ámbito comunitario de las minorías no supuso en los indicios de la
andadura comunitaria un hecho prioritario, pues en aquellos primeros
momentos se incidió en otros aspectos, como el económico o el
político que se consideraron más importantes. Sin embargo, con la
entrada en vigor del Tratado de Maastricht se produjo un cambio
significativo en este aspecto, ya que el reconocimiento de los derechos
de las minorías va a convertirse en una realidad. Desde entonces
se va a incidir mucho en su protección como queda patente en el
tratamiento que de él hace la Carta de los Derechos Fundamentales
o el Tratado de Lisboa. En este trabajo vamos ha hacer un recorrido
por la evolución que ha sufrido la protección de las minorías lingüísticas
en el ámbito comunitario, sin olvidar la labor realizada en
el seno de otras instituciones extracomunitarias, como es el caso del
Consejo de Europa entre otras, sin cuya labor no se hubieran alcanzado los niveles de protección de las lenguas minoritarias existentes

ha sido puesta de manifiesto desde el pensamiento filosófico clásico
griego. Sin embargo, recientemente puede apreciarse claramente
el creciente protagonismo y la inusitada actualidad que ha alcanzado
el tema de la búsqueda de la felicidad en el discurso político, lo que
obliga a meditar sobre ella como principio rector o directriz orientadora
del Estado Social, y a saber detectar su presencia —explícita
o implícita— en los textos constitucionales. Sólo en una sociedad
democrática, y desde el desarrollo efectivo de los derechos fundamentales
y de los derechos sociales, particularmente, será posible alcanzar
una vida digna, y a partir de ahí, obtener el basamento adecuado para
la búsqueda de la felicidad. La felicidad, pues, no es sólo un objetivo
individual, es también un asunto público que ha de venir propiciado
desde el propio Estado, en cuanto que desde los poderes públicos
pueden establecerse las bases adecuadas para su consecución. En la CE
de 1978 podemos encontrar preceptos para entender implícitamente
incluida la felicidad como directriz orientadora del Estado en sus
políticas públicas, y poder sostener así la presencia de una teoría eudemonista
en nuestro Estado Social. Percibir la existencia de una notable
preocupación por la felicidad de los ciudadanos en el desarrollo de las
políticas públicas actuales supone, en cualquier caso, un afortunado
retorno hacia el ámbito de lo humano, una nueva oportunidad para
preocuparnos por el ser persona.
Happiness has been linked to justice since ancient times, particularly
since the beginning of Greek Classical Thought. However, nowadays
the importance of happiness can surprisingly be found again in political
speech, which makes us think about it, and obviously it is worth
doing. Happiness could be considered as a main principle of the Social
State. This idea obliges us to look carefully into happiness in our
Constitutions. It is thought that only in a democratic society, where
social rights have been developed, can citizens get a dignified life, so
that they are able to look for happiness. Without a dignified life, happiness
is something impossible to achieve. Consequently, happiness
is said to be not only an individual objective, but also a common and
public target. The State should offer citizens the proper conditions
for the pursuit of happiness. In the Spanish Constitution, we get the
impression that it is possible to find happiness from some aspects of
it. So, according to this, the eudemonism theory could be reasserted in
our modern Social State. Currently, we can notice that public policies
are concerned with the happiness of citizens in order to improve
their daily lives, and actually governments are working on it in many
countries. In any case, this fact might be considered as a return to the
essence of human being. A good chance to try to understand what is
