As we know, when there is not a regulation in EU law, Member States possess a procedural autonomy. However, this called procedural autonomy must respect and guarantee the exercise of UE fundamental rights. ECJ developed a relevant jurisprudence in this matter that is very interesting. In this sense, I study the cases Unibet (C-432/05), Pannon GSM (243-08), Penzugyi (C-137/08), Domínguez (C-282/10), Banco Español de Crédito (C-618/10), and Aziz (415/11). And finally I highline the recent case Sánchez Morcillo (C-169/14). Thanks to this study we will be able to understand better actual perspectives of procedural autonomy and the right for citizens to benefit from effective judicial protection in the matter of consumer protection as a limit to this EU law principle.0ponencia congreso752<a class="citation_author_name" title="Navegar por nombre de Autor de Sarrión Esteve, Joaquín" href="/fez/list/author/Sarrión Esteve, Joaquín/">Sarrión Esteve, Joaquín</a>(<span class="citation_date">2014</span>) .<a class="citation_title" title="Click para ver : Effective judicial protection in consumer protection in the ECJ's case law" href="/fez/view/bibliuned:DptoDCONST-FDER-Ponencias-Jsarrion-001">Effective judicial protection in consumer protection in the ECJ's case law</a>. <b></b>.En: <span class="citation_conference_location">Cork</span>. One of the main objectives of municipal child participation organisations is to ensure that these spaces are inclusive. This means that they must promote equality of guarantees and conditions in the development of the right to participation from a perspective that addresses the different axes of inequality, not only in access to these spaces but also in the relational dynamics that take place in them. Based on a theoretical reflection on inclusion and participation, this article analyses the data from a questionnaire applied to 279 people (191 technical figures and 88 elected authorities) from 179 municipalities in Spain, which seeks to describe the state of child and adolescent participation in municipalities that are part of the International Association of Educating Cities, Child Friendly Cities, or both. A qualitative analysis is made of those issues related to the strategies used to promote inclusion within the Children’s Councils, as well as in the initiatives promoted in the field of child participation. The results show agreement in considering Children’s Councils to be inclusive bodies, but the means and procedures used do not always guarantee this inclusiveness.0432<a class="citation_author_name" title="Navegar por nombre de Autor de Morentin Encina, Javier" href="/fez/list/author/Morentin Encina, Javier/">Morentin Encina, Javier</a>, <a class="citation_author_name" title="Navegar por nombre de Autor de Noguera Pigem, Elena" href="/fez/list/author/Noguera Pigem, Elena/">Noguera Pigem, Elena</a> y <a class="citation_author_name" title="Navegar por nombre de Autor de Barba Núñez, María" href="/fez/list/author/Barba Núñez, María/">Barba Núñez, María</a> . garantía judicial y reforma de la Ley Orgánica del Poder Judicial = Taking rights seriously, the amparo appeal rearrangement and the reform of the Organic Law of the Judicial Branchbibliuned:DerechoPolitico-2013-88-1015Con ocasión de comentar la regulación de la protección de los derechos
In this paper, while discussing the regulation of fundamental rights
in the Proposal of Ammendment of the Judicial Branch Act, drafted
by the Institutional Committee established by resolution of the
Council of Ministers of March 2, 2012, Proposal issued in February 2013, we review the issues raised in the field of the procedural
management of fundamental rights in Spain.
The two proposed reforms in the area of our interest are: the establishment
of a procedure to guarantee the effectiveness of the
European Court Judgments in Spain and the disappearance of a
procedural mechanism that was established in 2007 («nulidad de
actuaciones»/«annulment of the procedures»). The former is welcome,
though the fact that perhaps it is also necessary to reform the Organic
Law of the Spanish Constitutional Court (Constitutional Court
Organization Act, LOTC hereinafter) is suggested. The latter is also
positively valued, but the establishment of additional guarantees,
such as specialized Chambers in High Courts of the Autonomous
Communities and a Chamber of the same type in the Supreme Court
is considered necessary.
A more literal application of the LOTC requirement of the invocation
of the right as soon as it has been violated is also suggested which
should improve the protection of rights.07082<a class="citation_author_name" title="Browse by Author Name for Tenorio, Pedro" href="/fez/list/author/Tenorio, Pedro/">Tenorio, Pedro</a> . This essay introduces a critical analysis on the legal content of the right to asylum on the grounds of sexual orientation and gender identity. It is suggested that the regulation of such rights under Spanish Law of Asylum 12/2009 it provides a restrictive and conditioned acknowledgement and introduces explicitly discriminatory elements. Furthermore, it is defended that, against current practice of national Administration, grave discriminatory acts in the access and enjoyment of social rights may constitute the objective element of persecution. Secondly, main procedural guarantees and reception conditions for LGBTI asylum-seekers are studied, under new asylum package approved by the European Union in June 2013. Lastly, according to the analyses of Spanish and European case-law, it is questioned the coherence and pertinence in the requirement of proving evidences and discretion criteria is rejected under the human rights approach.08112<a class="citation_author_name" title="Browse by Author Name for Díaz Lafuente, José" href="/fez/list/author/Díaz Lafuente, José/">Díaz Lafuente, José</a> . of the Charter, the right to a fair trial. It is not a new contribution of
the Charter but a guarantee which has been provided by EU Law for
decades. It first appeared as a procedural right, was later recognized
as a general principle of the EU and was finally embodied in the
Charter. Consequently this work recalls that process of recognition,
paying special attention to the judicial remedies provided by EU law
and to some specific rules of secondary —competition— law which
affect the context on which the right to a fair trial is developed. The
article concludes by underlining, on the one hand, the improvements
on the right to a fair trial brought about by this legal process and, on
the other hand, a few gaps on the issue which are neither recent nor
consistent with the effectiveness and completeness of such right as it
is required by the Rule of Law tradition.
Dick’s "The Man in the High Castle", Len Deighton’s SS-GB and their television adaptationsbibliuned:master-Filologia-ELyCIyPS-AsarasuaIn spite of being a literary genre that has its basis on questioning the consequences of modifying the outcome of a given historical event — an activity that has traditionally been performed since antiquity —, alternate history was not properly defined as such until the mid-1990s, having finally achieved a mainstream status as of the second decade of the 21st century thanks to the popularization of various television adaptations that have alternate history narratives as their source. These novels and their adaptations make display of an ability to portray the way in which the historical events they alter are shaped within the human mind as well as how they are perceived in collective memory. Consequently, the purpose behind this master’s dissertation is to analyse the aforementioned ability in two alternate history novels that have received their own television adaptation in recent years, namely Philip K. Dick’s The Man in the High Castle (1962) and Len Deighton’s SS-GB (1978), as well as to study the evolution of the public perception of the historical event that both share as the focus of their divergence in their original narratives and their modern television counterparts: a Nazi victory in World War II. After introducing the essential theoretical framework behind the literary genre, this dissertation will proceed to analyse Dick’s The Man in the High Castle, focusing on the features that identify it as an alternate history like the rupture of linear time and the reflection upon themes such as necessity, determinism and human agency, to then continue towards its connections with real-world history and the study of the normalization of the traumatic past while placing special attention on how its recent television adaptation has impacted on such process. Immediately afterwards, the same procedure will be applied to Deighton’s SS-GB and its corresponding television series. Finally, the conclusions of this dissertation will highlight the process of normalization as an ongoing matter of discussion that is definitely enriched by new audiovisual adaptations, as well as alternate history’s resourceful nature, that will likely guarantee its continuity as a genre regardless of the medium in which it is produced.0Doctoral Thesis6752<a class="citation_author_name" title="Navegar por nombre de Autor de Sarasúa Gutiérrez, Alexia" href="/fez/list/author/Sarasúa Gutiérrez, Alexia/">Sarasúa Gutiérrez, Alexia</a>.
The impeachment that took place in Paraguay on June 21st and
22nd, 2012, led to the removal from office of President Fernando
Lugo. It was marked by its speed and swiftness and resulted in the
suppression of the due process of law and the President’s right of defense
because of his dismissal within only 24 hours.
Consequently, the current debate is to determine if the impeachment
was a real trial or proceeding, with the required protection of constitutional
guarantees, or whether on the contrary, the impeachment
was political and should not be covered with such guarantees, allowing
the Senate to prosecute the President, establishing timeframes
and procedures for each case, without rightly accrediting the accusations that were formulated.
To resolve the question, this article analyzes the issue of impeachment
as established in the Paraguayan Constitution and its antecedents,
providing data of comparative law that regulates impeachment in Argentina,
and the opinions of Paraguayan constitutional doctrine about
the content, nature and scope of impeachment. Basic notions about
political responsibility, and control mechanisms in parliamentary and
presidential systems are established, highlighting their essential differences,
used later to analyze in detail each of the phases of impeachment
that ended with the removal of Fernando Lugo. This article also discusses the solutions against impeachment in the
Paraguayan system, carefully analyzing the two decisions of unconstitutionality
made by the Constitutional Chamber of the Supreme
Court: one against the regulation that was issued ex profeso prosecute
the president, in which he denounced violation of the prohibition of
lex praevia, right to defense and due process of the law; and the other
against the decision of the Senate that condemned him for malfeasance
and removed him as Head of State and Head of Government, in
which the same constitutional elements were invoked.
Finally, the article concludes with reflections on the legal nature of impeachment
and, in particular, on the constitutionality, validity and legitimacy
of the impeachment of the President, concluding that it was not
an impeachment in the true constitutional sense, and the political liberty
could have been altered by the early removal of a democratically elected
president, even though the process was evidently valid and legitimate,
confirmed as such by the Supreme Court of Justice.08542<a class="citation_author_name" title="Browse by Author Name for Balbuena Pérez, David-Eleuterio" href="/fez/list/author/Balbuena Pérez, David-Eleuterio/">Balbuena Pérez, David-Eleuterio</a> .
