(Observaciones preliminares sobre la modificación constitucional aprobada por el referéndum de 16 de abril de 2017)bibliuned:TeoriayRealidadConstitucional-2017-40-7150This paper discusses the politico-constitutional upheavals that took place in Turkey since 15 July 2016. While a state of emergency has been proclaimed to restore the public order disturbed by the attempted military coup, a constitutional modification, addressed to remove the parliamentary system, has been adopted under exceptional circumstances. The first question we considered in this paper is the constitutional practice of the state of emergency proclaimed, both in the perspective of the binding Constitution and the European Convention on Human Rights. Secondly, we analyzed the constitutional modifications, which appear very radical with respect to the continuity of the constitutional order, with respect to the time dimension of its effects, to the procedure adopted and the requirements of the rule of law. The article focuses on the purposes of criminal law and punishment, and what they can achieve in relation to victims and society in transitional contexts. As to victims, it proposes a reorientation of the victim-oriented theories of punishment towards consequentalism and the adoption of a wider concept of justice. As to society, it argues that in transitional contexts the main purpose is positive general prevention. We analyze the degree of housing deprivation faced by households in European countries when COVID-19 lockdown measures were enacted. To do so, we propose a synthetic measure that includes more dimensions than the official Eurostat indicator of severe housing deprivation. We use a fuzzy set approach to measure housing deprivation so that, unlike traditional deprivation approaches, based on a dichotomous variable, we can identify different degrees of housing deprivation for each household in the population. We find similar orderings of housing deprivation dimensions by country with the highest degree of deprivation in the living space dimension and the lowest one in the standard housing or technology deprivation dimension. Nonetheless, housing deprivation levels differ across countries, with Eastern European households being significantly more housing deprived than the rest when the lockdown began. No obstante, el alto Tribunal declaró constitucionales las referencias al «derecho a decidir de los ciudadanos de Cataluña» al no consagrar, a su juicio, un derecho de autodeterminación no reconocido constitucionalmente sino una aspiración política a concretar mediante un proceso ajustado a la legalidad constitucional, con respeto a los principios de «legitimidad democrática», «pluralismo» y «legalidad». La argumentación del Tribunal no sólo desestimó el argumento de que el derecho a decidir de los ciudadanos de Cataluña sólo puede existir una vez culminada la reforma constitucional sino que, además, acogió la doctrina de la Corte Suprema del Canadá sobre la secesión de Quebec, que apela a la posibilidad de que los miembros de una comunidad política puedan definir, sobre la base de mayorías claras y libremente conformadas, su propio marco jurídico-político. Ello no obstante, la STC 42/2014, a diferencia del Dictamen de la Corte canadiense no dio respuesta a la cuestión de si un referéndum consultivo y acordado con el Estado, como el planteado por algunas fuerzas políticas de Cataluña sobre el futuro político de este territorio, tiene cobertura constitucional. Con todo, contiene suficientes elementos que permiten pensar que ello es así. Y ese es precisamente el núcleo de la cuestión sobre la que se centra el presente trabajo, a partir del examen de algunas de las posibilidades que ofrece el orden constitucional español al respecto.The STC 42/2014, of 25 March, partially estimated unanimously the Government’s appeal against the «Resolution 5/X of the Catalan Parliament, establishing the sovereignty and the right to decide Declaration approving the people of Catalonia» declaring unconstitutional and void «the first principle, according to which the people of Catalonia has, for reasons of democratic legitimacy, the nature of political and legal sovereign subject». However, the High Court declared constitutional references to right to decide on the citizens of Catalonia to not consecrate, in his view, a right of self-determination but not constitutionally recognized political aspiration through a narrow set of constitutional legality process with respect to the principles of «democratic legitimacy», «pluralism» and «legality». Thus, the reasoning of the Court not only dismissed the argument that the right to decide the citizens of Catalonia can only exist after completion of constitutional reform but also accepted the doctrine of the Supreme Court of Canada on secession Quebec, which appeals to the possibility that members of a political community can be defined on the basis of clear and freely formed majorities, its own legal and political framework. Nevertheless, the STC 42/2014, unlike the opinion of the Canadian Court did not answer the question of whether an advisory and agreed with the State, such as that posed by some catalan political parties on the political future of that territory referendum, has constitutional coverage. However, it contains enough elements which suggest that this is so. multitudes constituyen un tema objeto de estudio por los investigadores
de los países que nos rodean. Este interés surge a raíz de las
movilizaciones que han tenido lugar en los últimos años en diferentes
lugares del mundo, principalmente dentro del ámbito europeo
y norteamericano. Los gestores policiales buscan nuevas aproximaciones
en estas movilizaciones para neutralizar escaladas de violencia
y evitar, al mismo tiempo, que la policía tenga que hacer uso
de la fuerza debido al peligro que comportan acciones violentas por
parte de una multitud de personas. Esta interacción entre la policía
y los manifestantes ha sido analizada en varios estudios recientes
y algunas policías modernas europeas (entre ellas la Policía de la
Generalitat- Mossos d‘esquadra) están poniendo en práctica estas
nuevas aproximaciones para respetar el derecho a manifestarse y expresarse
libremente por parte de los ciudadanos y a la vez proteger
la integridad física y los bienes durante estas movilizaciones. En este
estudio se exponen las más recientes metodologías para conseguir
esta reducción en el número de actos violentos
The policing and management of demonstrations and the management
of the crowds is an issue studied by researchers in our neighboring
countries and around the world. This interest arises from
the mobilizations that have taken place in recent years in different
places of the world, mainly in the AngloSaxon and North American
areas. Police managers seek new approaches to these mobilizations
in order to avoid the escalation of violence and at the same time
allowing the police to avoid having to use force because of the very
real possibility that it will invoke violent action from (all or) part of
the crowd. This interaction between the police and the demonstrators
has been analyzed in several recent studies and some modern
European (and Western) police organizations amongst them the Catalan
Police, are putting into practice these new approaches in order
to protect the citizen’s right to demonstrate and express themselves
freely but at the same time protect physical integrity and property

This issue demands to guarantee both the excercise of a fundamental right as well as the normal activity of this institution. It is commented the regulation existing in the United Kingdom and briefly the solution adopted in other Europenan countries. Then the Spanish situation is analyzed. At this point, the outcome is that both the proposed and existing legislation are clearly insufficient to reconcile these two requirements. En este sentido, la constitucionalización del principio de estabilidad presupuestaria deviene condición sine qua non para la recuperación de la confianza de los mercados en un contexto de crisis global, que hace necesario redefinir la política de déficit para adaptarla a las exigencias demandadas por los nuevos procesos en curso. Sin embargo, la constitucionalización de un límite a la deuda y gasto público lejos de representar una reforma menor que no afecta a aspectos sustantivos de la Carta Magna, implica una alteración sustancial y sin precedentes de nuestra forma de Estado social positivizada por el artículo 1.1 de la Constitución. Fundamentalmente, desde el punto de vista de la constitución económica del constitucionalismo social, verdadero ámbito de materialización de las trasformaciones actuadas por esta forma de Estado. De hecho, con la reforma se establece una nueva relación entre política y economía caracterizada por la centralidad de la estrategia de acumulación y la subordinación del vínculo social. La centralidad del mercado sitúa en el centro de la forma de Estado al mercado, y materializa en el ámbito formal constitucional, la constitución material del constitucionalismo de mercado europeo que ya se había infiltrado en el ámbito infraconstitucional. Por eso, consideramos erróneas aquellas reflexiones que definen la constitucionalización de la estabilidad presupuestaria como un ejercicio reformador coherente con el cuerpo básico de valores consensuado en 1978. En particular, porque la reforma rompe con la lógica dialéctica al superponer un elemento, la estabilidad presupuestaria, que no es susceptible de ser integrado en la dialéctica constitucional.In August 2011, the government and the main opposition party agreed the reform of Article 135 of the Spanish Constitution, arguing the need for a constitutional corset to the public deficit in order to face the challenges of the first systemic crisis of the globalization, which in turn juridification of an austerity principle of social State. In this sense, the constitutionalization of the principle of budgetary stability becomes a prerequisite for the recovery of market confidence in a context of global crisis that makes necessary to redefine the deficit policy in order to suit the requirements demanded by new processes in course. However, the constitutionalization of a limit to public debt and government spending, far from representing a minor reform that does not affect the substantive aspects of the Constitution, means a substantial alteration of our form of social State positivized by Article 1.1 of the Constitution. Basically, from the point of view of the economic constitution of social constitutionalism, true scope of realization of the transformations performed by this form of state. In fact, with the reform a new relationship between politics and economy is established. A relationship characterised by the centrality of the accumulation strategy and the subordination of the social spending. This centrality of the market stands the market at the centre of the form of State and materializes the material constitution of European market constitutionalism, already infiltrated into legislative sphere, in the formal constitutional space. For these reasons, we consider as inappropriate those proposals according to which the constitutionalization of budgetary stability is in line with the basic values adopted by our Constitution in 1978. Si en la década de los 80 el conflicto giró alrededor de la articulación de la educación pública y la de iniciativa social (y la correspondiente financiación de este tipo de educación) y en los debates entre pluralismo interno y pluralismo externo en la enseñanza, en los últimos años ha emergido el disenso en torno a qué debe entender por educación. En este sentido, ha cobrado actualidad el debate en torno al ideario educativo constitucional.
En el presente artículo se examina la existencia del ideario educativo constitucional y el alcance del mismo, a partir de su proyección en la resolución de conflictos jurídicos que en esta materia han tenido lugar en los últimos años.
Así, en primer lugar se analiza la cuestión de la educación en casa, y su interrelación con el mencionado ideario educativo constitucional, al objeto de determinar cuál es la finalidad de la educación.
En segundo término, y dado que el Tribunal Constitucional considera que la educación tiene una finalidad de integración social que va más allá de la transmisión de conocimientos, se analiza esta vertiente cívica de la educación, a partir de la polémica generada por la introducción en el currículo de la materia «Educación para la ciudadanía». En tercer lugar, y en atención a la relación entre ideología constitucional y enseñanza institucional, se considera la legitimidad de los colegios especializados por sexo.
Finalmente, a partir de las consideraciones efectuadas en los casos citados, se propone una concepción restrictiva del ideario educativo constitucional, en orden a preservar el pluralismo político y la distinción entre Estado y sociedad, clave en una sociedad democrática.The regulation of the educational rights has proven to be one of the most troubled of the Spanish constitutional experience. If in the 80s the conflict revolved around the articulation of public education and social initiative (and funding of such education) and discussions between internal and external pluralism in education, in recent years has emerged dissent about what is meant by education. In this sense, the debate has gained currency in the constitutional educational ideology.
In this paper is examined the existence and scope of the educational ideology of the Constitution, from its projection in the resolution of legal disputes in this area that have taken place in recent years.
Firstly, is analyzed the issue of home schooling, and its relationship with the above mentioned educational ideology of the Constitution, in order to determine what is the purpose of education.
Secondly, and given that the Constitutional Court considers that education has a purpose of social integration that goes beyond the transmission of knowledge, civic aspect of education is analyzed, from the controversy generated by the introduction into the curriculum of the subject «Education for Citizenship». Third, and in view of the constitutional relationship between ideology and institutional education is considered the legitimacy of the schools specialized by sex.

Rights of the European Union with regard to the European
Convention and the Spanish Constitution, in order to establish, on the basis of this premise, the existence of two fundamental rights, a
fundamental right to receive professional defence, and a second fundamental
right, which is composed, in association with other rights,
of the possibility of defending oneself.
The enforcement of the Charter by the Court of Justice of the European
Union and by the European Court of Human Rights is examined,
at different times in its history, up until its integration into the
Lisbon Treaty, through which the provisions of the Charter form part
of the primary legislation of the Union. Lastly, the manifestations of
the right to defend oneself are examined, and in particular the right
not to incriminate oneself in the caselaw of the CJEU and the ECHR.Se presenta un estudio sobre el derecho de defensa en la Carta de Derechos
Fundamentales de la Unión Europea en relación con el Convenio
Europeo y la Constitución Española para, a partir de esta premisa,
establecer la existencia de dos derechos fundamentales, un derecho
fundamental a la defensa técnica y un segundo derecho fundamental,
que estaría conformado, junto con otros derechos, por la posibilidad
de la autodefensa.
Se analiza la aplicación de la Carta, por el Tribunal de Justicia de la
UE y por el Tribunal Europeo de Derechos Humanos, en distintos
momentos históricos hasta su integración en el Tratado de Lisboa en
el que las disposiciones de la Carta forman parte del Derecho primario
de la Unión. Por último se estudian las manifestaciones del derecho a
la autodefensa y en especial el derecho a la no autoincriminación en la

ha sido puesta de manifiesto desde el pensamiento filosófico clásico
griego. Sin embargo, recientemente puede apreciarse claramente
el creciente protagonismo y la inusitada actualidad que ha alcanzado
el tema de la búsqueda de la felicidad en el discurso político, lo que
obliga a meditar sobre ella como principio rector o directriz orientadora
del Estado Social, y a saber detectar su presencia —explícita
o implícita— en los textos constitucionales. Sólo en una sociedad
democrática, y desde el desarrollo efectivo de los derechos fundamentales
y de los derechos sociales, particularmente, será posible alcanzar
una vida digna, y a partir de ahí, obtener el basamento adecuado para
la búsqueda de la felicidad. La felicidad, pues, no es sólo un objetivo
individual, es también un asunto público que ha de venir propiciado
desde el propio Estado, en cuanto que desde los poderes públicos
pueden establecerse las bases adecuadas para su consecución. En la CE
de 1978 podemos encontrar preceptos para entender implícitamente
incluida la felicidad como directriz orientadora del Estado en sus
políticas públicas, y poder sostener así la presencia de una teoría eudemonista
en nuestro Estado Social. Percibir la existencia de una notable
preocupación por la felicidad de los ciudadanos en el desarrollo de las
políticas públicas actuales supone, en cualquier caso, un afortunado
retorno hacia el ámbito de lo humano, una nueva oportunidad para
preocuparnos por el ser persona.
Happiness has been linked to justice since ancient times, particularly
since the beginning of Greek Classical Thought. However, nowadays
the importance of happiness can surprisingly be found again in political
speech, which makes us think about it, and obviously it is worth
doing. Happiness could be considered as a main principle of the Social
State. This idea obliges us to look carefully into happiness in our
Constitutions. It is thought that only in a democratic society, where
social rights have been developed, can citizens get a dignified life, so
that they are able to look for happiness. Without a dignified life, happiness
is something impossible to achieve. Consequently, happiness
is said to be not only an individual objective, but also a common and
public target. The State should offer citizens the proper conditions
for the pursuit of happiness. In the Spanish Constitution, we get the
impression that it is possible to find happiness from some aspects of
it. So, according to this, the eudemonism theory could be reasserted in
our modern Social State. Currently, we can notice that public policies
are concerned with the happiness of citizens in order to improve
their daily lives, and actually governments are working on it in many
countries. In any case, this fact might be considered as a return to the
essence of human being. A good chance to try to understand what is

La reiteración de estos comportamientos, cada vez más habituales en nuestra vida parlamentaria, viene desde hace tiempo exigiendo del Derecho Parlamentario una respuesta que sea al mismo tiempo acorde con los principios de un Estado democrático, compatible con el fluido funcionamiento de una de sus más importantes instituciones, y susceptible de ser aplicada de manera coherente en nuestros diferentes legislativos. En el presente artículo se aventura por primera vez, y a partir del análisis de varios casos recientes, esta posible solución.To attend a parliamentary sitting wearing clothes featuring a clearly readable political message, is a kind of manifestation of the freedom of speech, or an unacceptable interference in the development of the parliamentary debates, likely to alter the order in the house? Is it acceptable for a Member of Parliament to express his or her opinion within the hemicycle wearing pins o stickers, showing flyers or deploying banners?
The reiteration of these behavior, increasingly common in our parliamentary life, has been demanding from Parliamentary Law an answer that is at the same time consistent with the principles of a democratic State, compatible with the fluid operation of one of its most important institutions, and suitable of being applied in a consistent manner in our different legislatures. Este trabajo analiza con ojos críticos el criterio mantenido recientemente por el Tribunal Supremo en esta materia al denegar la autorización para la interposición del recurso de revisión basándose en la supuesta carencia de objeto del recurso porque cuando la Ley de Memoria Histórica declara la injusticia e ilegitimidad de dichas condenas las priva de eficacia jurídica. Una respuesta que, como se explicará en las siguientes páginas, vulnera el derecho a la tutela judicial efectiva en dos de sus dimensiones concretas: el derecho de acceso al proceso y, el derecho a un resolución fundada en derecho; pero que afecta también indirectamente al derecho a la presunción de inocencia.
Una forma gráfica de presentar esta crítica es exponiéndola a través de un caso concreto; el de una víctima paradigmática del franquismo, el poeta Miguel Hernández y su familia a quienes inexplicablemente ambos tribunales les hayan cerrado las puertas.Appeal by review (revisión) against judgment, that has already gained res judicata, is an extraordinary remedy based upon reasons of Justice. When this appeal by review is used for the annulment of judgments of Franco dictatorship, this well known statement had been in the past, and has been nowadays, a very controversial issue politically, doctrinally and jurisprudentially.
This critical paper analyses the Spanish Supreme Court’s opinion uphold in this matter to deny the previous authorisation, which is requiered for filing the petition of the appeal by review. The Supreme Court based its decision on a alleged lack of purpose for this review procedure because when the Historical Memory Law declares injustice and illegitimacy of those sentences, this Law deprives them also of their legal effect. This answer, as we explained in the following pages, violates the due process (as a fundamental right of effective judicial protection) in two of its specific dimensions: the right of access to the courts and judicial procedure and the right to a decision based in law, but also indirectly affects the presumption of innocence.

de escuchas ilegales practicadas por los periodistas del tabloide News of
the World. Este hallazgo ha puesto al descubierto una compleja red de
conexiones entre la prensa, la policía y los políticos en Reino Unido.
Tras varios meses de investigación, el Informe Leveson sobre la cultura,
prácticas y ética de la prensa presenta numerosas propuestas para
someter a la prensa a un nuevo mecanismo de autorregulación más
independiente y garantista que comprometa a una práctica ética del
periodismo así como para asegurar los derechos de las personas objeto
de información en los medios.
The regulation of the British press is undergoing a major process
of reform after the biggest scandal of phone hacking carried out by
journalists from the tabloid News of the World broke in July 2011.
This finding has uncovered a complex network of connections among
the press, the police and politicians in the UK. After several months
of investigation, the Leveson Inquiry into the culture, practices and
ethics of the press has made numerous proposals in order for the press
to be covered by a new independent self— regulatory regime leading
to the ethical practice of journalism and guaranteeing the rights of

Hasta ahora, la protección de estos valores fundamentales se encuentra en el mecanismo previsto en el Art. 7 del TUE. La existencia de este mecanismo no ha logrado, sin embargo, evitar la vulneración de los valores fundamentales de la UE por parte de varios de sus Estados miembros. En este sentido, este trabajo propone la formulación de un nuevo mecanismo —«mecanismo de Copenhague»— que sea capaz de hacer un seguimiento permanente de la actuación de los Estados para evitar que se produzcan esas vulneraciones, pero que sea capaz también de imponer las sanciones más graves a las vulneraciones de estos valores fundamentales, incluida la expulsión de la UE.The UE is founded on a set of values which are mentioned in an explicit manner in Art. 2 of the TEU: respect for human dignity, freedom, democracy, equality, the rule of law and respect for human rights. Values which the same article states that are common to the Member States. Until now, the protection of these fundamental values is based on the mechanism foreseen in Art. 7 of the TEU. The existence of this mechanism though has not prevented the violation of these fundamental values by several of the Member States from taking place. So, in addition to creating an effective area of freedom, which is expressed in the subject dimension of the right, it is no less important the objective aspect that it entails, because, by its realization is to achieve an effective limitation and control the exercise of public power by the European institutions. Therefore, Article 15.3 TFEU, in conjunction with Article 42 EUCFR recognizes the citizens’ right of access to documents held by the EU institutions. Court of Human Rightsbibliuned:DerechoPolitico-2013-88-1035Este artículo analiza la jurisprudencia del Tribunal Europeo de Derechos
Humanos sobre el sufragio activo (artículo 3 del Protocolo I).
Para ello, partimos de la consideración de que en este derecho debe
reconocerse además de una dimensión subjetiva, que define la posición
jurídica de los ciudadanos en su relación con los poderes públicos y
se concreta en los principios de sufragio universal, libre e igual, una
dimensión objetiva en tanto que elemento esencial del Estado Democrático,
lo que origina una obligación positiva de los poderes públicos
para la realización de su contenido: la libre expresión del pueblo en las elecciones del cuerpo legislativo. Sin embargo, el desarrollo de las
obligaciones positivas del Estado no ha agotado todas sus posibilidades
de manera que el Tribunal Europeo de Derechos Humanos reconoce
un amplio margen de apreciación de los Estados en la definición
de los sistemas electorales y de las normas del procedimiento electoral.
This article analyzes the European Court of Humans Rights’ jurisprudence
on right to vote (article 3 of Protocol n.º I ). For this purpose,
it must be acknowledged a subjective dimension too which defines
the legal status of citizen in its relations with the public authorities
that can be specified in the principle of universal, equal and free suffrage,
an objective dimension as an structural element of Democracy
and what creates positive obligations to public authorities in order to
implement the content of the right: «to ensure the free expression of
the opinion of the people in the choice of the legislature». However,
the development of positive obligations on the basis of Article 3 of
Protocol No. 1 goes no further than this. So, the Court considers that
this provision does not require the States to implement a specific electoral
system or electoral rules because the State enjoys a wide margin

cierto protagonismo en el marco del Estado autonómico al ser esgrimido
como argumento para justificar algunas propuestas encaminadas
a afrontar los nuevos retos que plantea la crisis económica. Sin embargo,
aunque jurídicamente indeterminado, este concepto ni puede ser
identificado con cualquier circunstancia, ni tampoco puede dar cobertura
a cualquier medida. La Constitución ya plasmó el interés general
en la distribución de competencias efectuada en el Art. 149 CE en
favor del Estado y también previó que con carácter extraordinario se
pueda recurrir a él como presupuesto habilitante en los casos de aprobación
de leyes de armonización y de adopción de medidas de coerción
frente a incumplimientos autonómicos o a lesiones de ese mismo interés.
De la propia Constitución, en definitiva, cabe derivar quién, en
qué casos, con qué límites y con qué garantías ha de concretar un interés
general que, si bien se vincula al principio de unidad, tal y como
aparece configurado no puede prescindir del principio autonómico, en
tanto ambos son fundamento de nuestro modelo territorial. El interés
general es el interés del Estado entendido como un todo y por ello no puede ser ajeno a ninguna de las partes que lo componen.In recent times, the concept of general interest has become central
within the autonomous State’s framework as it has been put forward
as an argument to justify certain proposals designed to face the new
challenges brought by the economic crisis. However, although it is
legally undetermined, this concept cannot be identified whit just
any circumstance, nor can it cover any measure. The Constitution
has already reflected general interest in the power distribution set
in Article 149 CE in favour of the State, and also legislates that, in
extraordinary circumstances, it can be used to as an enabling precondition
in order to in cases which pass harmonization laws and adopt
coercion measures against autonomous non-compliance. The Constitution
itself also provides a source for deriving in which cases, with
what limits and with which guarantees general interest should be set.
Though this interest is linked to the principle of unity, the principle
of autonomy cannot be ignored. As the situation is set up now, both
principles are essential to our territorial structure. General interest
is the interest of the State understood as a whole, and, as a result, it

iniciativa popular caracteriza el régimen suizo en línea con su apuesta
por la utilización de mecanismos de democracia directa. Sin embargo,
la estrechez de los límites constitucionales impuestos a estas iniciativas
puede dar lugar a serias contradicciones entre el orden jurídico-político
interno y los compromisos internacionales asumidos por el país, lo que
resulta particularmente grave en lo que se refiere a los derechos humanos.
Así, la aprobación en 2009 de una nueva disposición constitucional
que prohíbe taxativamente la construcción de minaretes en la Federación
Helvética supone una fuente de conflictos normativos que parte
desde la posible violación de la libertad religiosa o el derecho a la no
discriminación, protegidos por las principales normas internacionales de
derechos humanos. En las condiciones actuales, hallar una solución estable
a esta suerte de contradicciones normativas resulta complicado, toda vez que la cultura política suiza es reacia tanto a ensanchar los límites de
la soberanía popular como a recibir correcciones de jueces extranjeros.
De este modo, se presentan por un lado una serie de problemas o dificultades
de orden jurídico y por otra parte, cuestiones de naturaleza
política. Entre las primeras, debe analizarse en primer lugar si una prohibición
de la construcción de minaretes en sede constitucional entraña
una violación de los derechos a la libertad religiosa o a la no discriminación
tal y como se recogen en normas internacionales, especialmente
el Convenio Europeo de Derechos Humanos. Respecto a este mismo
punto, cabe estudiar el acceso al Tribunal Europeo de Derechos Humanos
como garante de dicho convenio contra la disposición constitucional
suiza o las decisiones tomadas en aplicación de la misma. En segundo
lugar, es preciso estudiar los conflictos que pueden producirse en el
orden suizo entre normas constitucionales y normas internacionales, así
como plantear posibles soluciones a las mismas. Por lo que se refiere a las cuestiones de orden político, su análisis
deviene relevante para contextualizar adecuadamente las dificultades
jurídicas explicadas. En primera instancia, es conveniente estudiar el
significado del referéndum planteado en 2009 respecto de la construcción
de nuevos minaretes en un país que apenas cuenta con cuatro de
estas construcciones. La cultura política tradicional de Suiza ayuda en
este sentido a entender las dificultades de articulación entre la democracia
directa y un posible control jurídico internacional, así como la
relativa ausencia de controles internos, en sede judicial o parlamentaria
de las iniciativas populares. El peculiar modelo suizo se presenta
así problemático en un contexto de armonización europea sobre la
base de un marco común de protección de derechos humanos.
El análisis conduce a resaltar la necesidad de ensanchar los filtros de
admisión de iniciativas populares, reinterpretando el concepto de
normas imperativas de Derecho internacional a fin de incluir en las
mismas los elementos de los derechos humanos que pueden constituir
hoy en día parte de un acervo europeo común.The option to approve by referendum constitutional amendments proposed
by popular initiatives is one of the characteristic of the Swiss regime,
which fosters the use of direct democracy mechanisms. However,
the narrowness of the constitutional limits to this kind of initiatives
may open the door to serious contradictions between the domestic legal
order and those international commitments undertaken by the country,
being this particularly relevant in respect of human rights protection.
Thus, the approval in 2009 of a new constitutional clause banning the construction of minarets in the Helvetic Federation entails a set of legal
questions, starting from the possible violation of the religious freedom
or the right not to be discriminated against, both protected by the
highest international norms on human rights. Within the current conditions,
finding an stable solution to these legal inconsistencies seems
difficult, being the Swiss political culture reluctant to enlarge the limits
of the popular sovereignty and to receive mandates from foreign judges.
In this way, we face on the one hand problems or difficulties in the legal
field and, on the other hand, questions of a political nature. Among
the former, it must be firstly analysed whether the ban for construction
of new minarets at the Constitution entails per se a violation freedom of
religion or the right not to be discriminated against, in the way these
rights are understood in the main international human rights instrument,
such as the European Convention of Human Rights. In relation
to the same point, it is also possible to study the access to the European
Court of Human Rights as legal guarantee of the aforementioned treaty,
appealing against the constitutional clause or against the possible
decisions taken in its implementation. Secondly, it is necessary to reflect
about the conflicts that may arise at the Swiss legal order between
constitutional dispositions and international norms, as well as look for
possible solutions to these inconsistencies. As for the political aspects, their analysis becomes relevant to rightly
contextualize the aforementioned legal difficulties. Firstly, it is
necessary to reflect about the real meaning of the 2009 referendum
in a country where no more than four minarets can be found. The
traditional political culture of Switzerland helps in this respect to
understand the difficulties to put together direct democracy and
international legal controls, or the absence of parliament or judicial
domestic controls for popular initiatives. The peculiar Swiss model is
thus a problematic one in a context of European harmonisation on the
basis of a common framework of human rights protection.
The analysis brings us to underline the need to enlarge the admission
filters of the popular initiatives, adopting a new interpretation of the
concept of peremptory norms of international law, with the aim of
including in it those elements of human rights that constitute today

of the multiculturalism and plurality which is the basis of today’s
Europe. That is why the EU institutions have adopted various regulations
aimed at the promotion, preservation and protection of the languages
used by EU citizens, especially those of so-called regional or
minority groups. Though implementing this protection is delegated
to Member States themselves, the EU authorities for their part have
also taken decisive steps in order to ensure the continued health of the
languages that enrich the idiosyncrasies of both the Member States
and of the Union itself. While the protection of minorities at a Community
level was not an initial priority at the outset of the EU given
the greater importance of economic and political considerations.
However, with the entry into force of the Treaty of Maastricht there
has been a significant change in this respect; the recognition of minority
rights has now become a reality. This recognition is now given
due consideration as evidenced by the provisions of both the Charter
of Fundamental Rights and the Treaty of Lisbon. This paper has outlined
the progress that has been made in the protection of linguistic
minorities at the EU community level, without forgetting the work
within other extra-Eu institutions, as it is the case of the Council of
Europe, among others, without whose work the levels of protection of
existing minority languages not have reached today.La diversidad lingüística existente en el seno de la Unión Europea
supone una expresión de la multiculturalidad y de la pluralidad
que no es sino la base de la Europa actual. Es por ello que desde las
instituciones han sido adoptadas distintas normativas tendentes a
la promoción, conservación y protección de la lenguas utilizadas
por los ciudadanos comunitarios, especialmente de las denominadas
regionales o minoritarias, ya que si bien es verdad, que esta protección
ha de ser llevada a cabo por los propios Estados miembros, las
autoridades comunitarias han dado pasos decisivos en aras a garantizar
la no desaparición de las lenguas que enriquecen la idiosincrasia
tanto de los Estados como de la propia Unión. La protección en el
ámbito comunitario de las minorías no supuso en los indicios de la
andadura comunitaria un hecho prioritario, pues en aquellos primeros
momentos se incidió en otros aspectos, como el económico o el
político que se consideraron más importantes. Sin embargo, con la
entrada en vigor del Tratado de Maastricht se produjo un cambio
significativo en este aspecto, ya que el reconocimiento de los derechos
de las minorías va a convertirse en una realidad. Desde entonces
se va a incidir mucho en su protección como queda patente en el
tratamiento que de él hace la Carta de los Derechos Fundamentales
o el Tratado de Lisboa. En este trabajo vamos ha hacer un recorrido
por la evolución que ha sufrido la protección de las minorías lingüísticas
en el ámbito comunitario, sin olvidar la labor realizada en
el seno de otras instituciones extracomunitarias, como es el caso del
Consejo de Europa entre otras, sin cuya labor no se hubieran alcanzado los niveles de protección de las lenguas minoritarias existentes
