The European Union (EU), compared to China and the United States, is losing its capacity for innovation and control over data and fundamental raw materials and could even lose ground in the regulatory power it has in the digital realm. This paper pays special attention to the situation and progress toward a new European policy to achieve digital strategic autonomy. It also briefly outlines the Recovery Plan for Europe as a possible incentive for its promotion. Both descriptive and analytical methods were employed to gather the data from secondary sources and provide reliable research results. The major findings of this article are that strategic autonomy is an imperative requirement for sustaining and encouraging European integration, forcing the EU to advance faster toward developing critical digital technologies. There is also an urgent need to secure critical parts of supply chains and data protection, intellectual property, and defense against disinformation. la reforma marcelista se han atribuido a
menudo a las dificultades del Presidente
del Consejo para maniobrar,
prácticamente sin margen y sin tiempo,
entre poderosas presiones políticas
contrapuestas. Sin embargo, el análisis de
su pensamiento político, expreso en las
manifestaciones realizadas durante los
años de su Gobierno, revelan que en lo
sustancial su ideario nunca se salió de los
parámetros ideológicos y políticos del
Estado Novo. Su reformismo no iba más
allá de un intento honesto de relegitimar el
régimen mediante un proceso de efectiva
institucionalización de la actividad política,
de dinamización representativa, de
modernización socioeconómica y de

challenges of Portuguese society that
eventually led to the outbreak of 25th April.
The reasons for this failure have been
often linked to the President’s difficulties to
implement changes in the midst of
powerful and opposed political pressures.
Nevertheless, the analysis of his political
thought expressed in the speeches and
statements produced during his
government period, shows that essentially
marcelist’s ideas never exceeded the
«Estado Novo» ideological framework. So,
his reforming policy never went beyond an
honest attempt to renew the regime
throughout a more institutionalised and
representative political practice, a deeper
tolerance of public liberties and an
economic and social modernization. All
that could at the ouset raise popular
hopes, but it could never flow into

Portuguesa, tratamos de reflexionar sobre
la difusión de un vocabulario de otros
contextos intelectuales, como de la
Independencia de los Estados Unidos.The aim of this study is to situate the
rhetoric of republican liberty and journalist
Cipriano José Barata de Almeida in his
intellectual context. A major problem in the
interpretation of texts as the newspaper
«Sentinela da Liberdade na Guarita de
Pernambuco» (1823; 1831-1834) is to
identify the intellectual origins of some
concepts, such as republicanism. From
this perspective, we try to see how
Cipriano Barata is influenced of civic spirit
that based on the free republic,
independent and autonomous. Beyond the
influence of Portuguese Enlightenment,
we try to reflect on the diffusion of a
vocabulary from other intellectual contexts,

limitación de derechos fundamentales (especialmente, libertad personal);

de amparo al respecto. En tal sentido, se analiza el marco normativo de

Through the working hypothesis, it was established that the Iberian country has a wide margin for improvement in the context of digitalization. Likewise, that NGEU forms a key impulse for the recovery from the crisis caused by Covid-19, as well as for the implementation of new digital technologies in Spain. The use of the Digital Economy and Society Index, developed by the European Commission, has allowed us to carry out empirical research. The evaluation of the current situation and the progress of Spain in the field of analysis, as well as the putting it in perspective regarding the rest of the Member States, have been undertaken. Also, to highlight the importance of digital transformation and the funds provided through the Next Generation EU (NGEU) to fight against this phenomenon. Based on data from the National Institute of Statistics (INE), an empirical investigation about the current state of population abandonment in Spain has been carried out. Moreover, the Digitization Index (DiGiX) has been used to obtain a territorial vision about the digitization degree of the Autonomous Communities (CCAA). Finally, the estimates of the Spanish executive set out in the National Recovery, Transformation and Resilience Plan (RTRP) have been used to underline the importance of Next Generation EU resources to fight the problem of „empty Spain‟. That was to see that mentioned country is currently at the head of the „demographic deserts‟ of the EU. Likewise, the Recovery Plan for Europe, and its digital axe, constitute one of the key factors to combat the population abandonment of the Spanish rural areas. imprenta durante la primera experiencia constitucional en España. En el
examen del contexto de su reconocimiento se observa que la libertad de
imprenta se alcanzó antes de facto que de iure, circunstancia que facilitó
enormemente la libre circulación de todo tipo de escritos y que, asimismo,
coadyuvó al intercambio de ideas sobre el nuevo modelo de Estado.
Del estudio de las principales razones que motivaron la aprobación
del Decreto de imprenta de 1810 se desprende que las Cortes no
concibieron la libertad de imprenta exclusivamente como un derecho
individual que posibilitaba el libre desarrollo de la personalidad sino
que, además, se trataba de un derecho llamado a desempeñar importantes
funciones en el nuevo modelo político que deseaban implantar.
Idea que corrobora el análisis del proceso constituyente y del funcionamiento
de las instituciones creadas por la Constitución de 1812.
Concretamente, en referencia al proceso constituyente, se observa que
con carácter previo a la aprobación de una Constitución digna de ser
calificada como racional-normativa, fue imprescindible reconocer y
garantizar la libertad de imprenta. Y, en relación al funcionamiento
de las nuevas instituciones liberales, la citada libertad pública era del
todo necesaria, dado que, entre otras cuestiones, posibilitó a los españoles
fiscalizar y controlar el ejercicio del poder político.Present contribution studies the role that freedom of the press fulfilled
during the first constitutional experience in Spain. Within the
study of the context of its recognition it is observed that Freedom of
the press was achieved before de facto rather than de iure. This circumstance
made possible the circulation of all kind of documents which
also contributed to the exchange of ideas about the new State model.
From the study of the main reasons that motivated the approval of the
Press Decree of 1810 can be inferred that Courts did not only conceive
Freedom of the press as a mere individual right that enabled the
free development of personality, but also as a right that was expected
to fulfill important functions in the new political model that was intended
to be established. This idea is corroborated by the analysis of
the constituent process and the work environment of the institutions
created in the 1812 Constitution. With reference to the constituent
process, it is observed that previous to the approval of a Constitution
that could be called as rational- regulatory, it was compulsory
to recognize and guarantee the Freedom of the press. Finally, and
related to the work environment of the new liberal institutions, the
aforementioned public liberty was entirely necessary as it allowed the
citizens the supervision and control of the political power’s exercise

Paraguay, por el que fue separado del cargo el Presidente Fernando
Lugo, estuvo marcado por la rapidez y la celeridad, lo que supuso
una supresión del pleno ejercicio del derecho de defensa por parte del
Presidente al haber sido destituido en tan solo 24 horas. En consecuencia,
el debate suscitado reside en determinar si el juicio político
es un verdadero juicio o proceso, si debe quedar amparado por el resto
de garantías constitucionales como el derecho de defensa y el debido
proceso, o si, por el contrario, al tratarse de una cuestión política, no
debe estar revestido de dichas garantías pudiendo la Cámara de Senadores
enjuiciar al Presidente de la República disponiendo libremente
los plazos y demás solemnidades en cada caso concreto y sin que haya
necesidad de acreditar las acusaciones que se formulan.
Para dirimir la cuestión, en el presente artículo se analiza la figura del juicio político tal y como está regulada en la Constitución paraguaya
y sus antecedentes, aportando algunos datos de Derecho comparado
—en concreto la regulación del juicio político en Argentina— y las
opiniones de la doctrina constitucionalista paraguaya sobre el contenido,
naturaleza y alcance del juicio político. Se establecen previamente
las nociones básicas acerca de la responsabilidad política y de los mecanismos
de control en los sistemas parlamentarios y presidencialistas,
resaltando sus diferencias esenciales, para posteriormente analizar, de
forma pormenorizada, cada una de las fases del juicio político que
terminó con la destitución de Lugo. También se estudian los medios de impugnación contra el juicio político
en el ordenamiento paraguayo, analizando detenidamente las resoluciones
de la Sala Constitucional de la Corte Suprema de Justicia dictadas
en las dos acciones de inconstitucionalidad que el Presidente interpuso:
una contra el reglamento que se dictó ex profeso para enjuiciarle, en la
que se denunciaba vulneración de la prohibición de lex praevia, derecho
de defensa y debido proceso; y otra contra la resolución de la Cámara de
Senadores (sentencia) que le condenó por mal desempeño de funciones y
le separó del cargo como Jefe de Estado y Jefe de Gobierno, en la que se
invocaron los mismos motivos constitucionales de fondo. Finalmente, se concluye con unas reflexiones sobre la naturaleza jurídica
del juicio político y, en concreto, sobre la constitucionalidad,
validez y legitimidad del juicio político al que fue sometido el Presidente,
concluyendo que no fue un juicio político en su verdadero significado
constitucional y que pudo verse alterada la libertad política al
destituir anticipadamente a un presidente democráticamente elegido,
aunque el proceso es plenamente válido y legítimo por cuanto que el
control de constitucionalidad ejercido por la Corte Suprema de Justicia
ha confirmado su correcto anclaje constitucional.The impeachment that took place in Paraguay on June 21st and
22nd, 2012, led to the removal from office of President Fernando
Lugo. It was marked by its speed and swiftness and resulted in the
suppression of the due process of law and the President’s right of defense
because of his dismissal within only 24 hours.
Consequently, the current debate is to determine if the impeachment
was a real trial or proceeding, with the required protection of constitutional
guarantees, or whether on the contrary, the impeachment
was political and should not be covered with such guarantees, allowing
the Senate to prosecute the President, establishing timeframes
and procedures for each case, without rightly accrediting the accusations that were formulated.
To resolve the question, this article analyzes the issue of impeachment
as established in the Paraguayan Constitution and its antecedents,
providing data of comparative law that regulates impeachment in Argentina,
and the opinions of Paraguayan constitutional doctrine about
the content, nature and scope of impeachment. Basic notions about
political responsibility, and control mechanisms in parliamentary and
presidential systems are established, highlighting their essential differences,
used later to analyze in detail each of the phases of impeachment
that ended with the removal of Fernando Lugo. This article also discusses the solutions against impeachment in the
Paraguayan system, carefully analyzing the two decisions of unconstitutionality
made by the Constitutional Chamber of the Supreme
Court: one against the regulation that was issued ex profeso prosecute
the president, in which he denounced violation of the prohibition of
lex praevia, right to defense and due process of the law; and the other
against the decision of the Senate that condemned him for malfeasance
and removed him as Head of State and Head of Government, in
which the same constitutional elements were invoked.
Finally, the article concludes with reflections on the legal nature of impeachment
and, in particular, on the constitutionality, validity and legitimacy
of the impeachment of the President, concluding that it was not
an impeachment in the true constitutional sense, and the political liberty
could have been altered by the early removal of a democratically elected
president, even though the process was evidently valid and legitimate,
