El sistema, influenciado notoriamente por la Constitución norteamericana, presenta notas características de la idiosincrasia japonesa que resultaran de interés para el lector occidental. En el presente trabajo se realiza un estudio sobre la garantía de esta libertad (tanto en su vertiente ideológica como religiosa) a través del análisis de la evolución histórica del sistema, de la revisión de la doctrina científica más aplaudida y de la jurisprudencia más relevante sobre la materia.The Constitution of Japan (1947) guarantees the right to freedom of belief, which is systematized in several articles of the text. Having received a notorious influence from the U. S Constitution, the system shows some characteristic features that should be of interest to western scholars. La reiteración de estos comportamientos, cada vez más habituales en nuestra vida parlamentaria, viene desde hace tiempo exigiendo del Derecho Parlamentario una respuesta que sea al mismo tiempo acorde con los principios de un Estado democrático, compatible con el fluido funcionamiento de una de sus más importantes instituciones, y susceptible de ser aplicada de manera coherente en nuestros diferentes legislativos. En el presente artículo se aventura por primera vez, y a partir del análisis de varios casos recientes, esta posible solución.To attend a parliamentary sitting wearing clothes featuring a clearly readable political message, is a kind of manifestation of the freedom of speech, or an unacceptable interference in the development of the parliamentary debates, likely to alter the order in the house? Is it acceptable for a Member of Parliament to express his or her opinion within the hemicycle wearing pins o stickers, showing flyers or deploying banners?
The reiteration of these behavior, increasingly common in our parliamentary life, has been demanding from Parliamentary Law an answer that is at the same time consistent with the principles of a democratic State, compatible with the fluid operation of one of its most important institutions, and suitable of being applied in a consistent manner in our different legislatures. Sí lo hace, por el contrario, el Convenio núm. 196 del Consejo de Europa de 2005 que caracteriza la provocación pública al terrorismo incluyendo deliberadamente la incitación indirecta, exigiendo una intencionalidad específica y un resultado de peligro de comisión de un delito terrorista. El Informe explicativo del Convenio remite a la jurisprudencia del TEDH para establecer los elementos a considerar en la apreciación de dicho peligro haciendo así de ella un parámetro interpretativo. La Decisión Marco del Consejo de la Unión Europea ha adoptado desde 2008 la misma definición que el Convenio por lo que cabe hablar de un modelo europeo de penalización de la incitación al terrorismo que ha sido criticado por utilizar un definición abierta y general en conflicto con el principio de seguridad jurídica y por la indeterminación de la naturaleza del peligro provocado por la incitación. Estas críticas no han impedido, sin embargo, que el Relator Especial de las Naciones Unidas haya considerado la definición del Convenio como una práctica óptima en la lucha contra el terrorismo. Con posterioridad al Convenio, el TEDH ha dado lugar a desarrollos jurisprudenciales relevantes sobre la incitación indirecta como los casos Leroy (2008) y Yavuz y Yayali (2013). El enfoque norteamericano que requiere inminencia y probabilidad del peligro es el referente de las posiciones críticas con el estándar europeo que se pretende extender universalmente en un proyecto de convenio internacional para la prevención de la incitación al terrorismo surgiendo la problemática de su adecuación más allá del contexto europeo en el que ha surgido.Resolution 1624 (2005) of the Security Council of the United Nations does not define incitement to terrorism. By contrast, Council of Europe Convention n.º 196 on the Prevention of Terrorism (2005) characterizes public provocation to terrorism deliberately including indirect incitement and requiring both specific intent and a result of danger of commission of a terrorist offense. The Explanatory Report of the Convention refers to the case-law of the ECtHR to fix on the elements to be considered in the assessment of the danger, thus making it an interpretative parameter. The Framework Decision of the Council of the European Union has adopted since 2008 the same definition that the Convention as it is possible to speak of a European model of criminalization of incitement to terrorism that has been criticized for using a broad and open definition in conflict with the principle of legal certainty and not determining the nature of the danger caused by incitement. These criticisms have not prevented, however, that the Special Rapporteur of the United Nations has considered the definition of the Convention as a best practice in the fight against terrorism. After the Convention, the ECtHR has led to relevant developments of case-law on the indirect incitement as cases Leroy (2008) and Yavuz and Yayali (2013). Valores que el mismo precepto considera que son comunes a todos los Estados miembros. Hasta ahora, la protección de estos valores fundamentales se encuentra en el mecanismo previsto en el Art. 7 del TUE. La existencia de este mecanismo no ha logrado, sin embargo, evitar la vulneración de los valores fundamentales de la UE por parte de varios de sus Estados miembros. En este sentido, este trabajo propone la formulación de un nuevo mecanismo —«mecanismo de Copenhague»— que sea capaz de hacer un seguimiento permanente de la actuación de los Estados para evitar que se produzcan esas vulneraciones, pero que sea capaz también de imponer las sanciones más graves a las vulneraciones de estos valores fundamentales, incluida la expulsión de la UE.The UE is founded on a set of values which are mentioned in an explicit manner in Art. 2 of the TEU: respect for human dignity, freedom, democracy, equality, the rule of law and respect for human rights. Values which the same article states that are common to the Member States. Until now, the protection of these fundamental values is based on the mechanism foreseen in Art. 7 of the TEU. The existence of this mechanism though has not prevented the violation of these fundamental values by several of the Member States from taking place. Así, además de la creación de un espacio efectivo de libertad, que se expresa en la dimensión subjetiva del derecho, no es menos importante la vertiente objetiva que el mismo lleva aparejada, ya que, mediante su realización, se pretende alcanzar la efectiva limitación y control del ejercicio del poder público por parte de las instituciones. En este trabajo se analiza la restringida significación alcanzada por tan trascendental derecho, que pone a prueba la sinceridad de los objetivos apuntados.All legitimate institutional system requires, today, from a democratic perspective, as a guarantee of good governance, first, a commitment to openness and transparency of its organs, that allows for the exercise of its functions accessible to the public, and second, the recognition of the means necessary to enable the development of citizens’ initiatives aimed at obtaining the information they deem appropriate to request. So, in addition to creating an effective area of freedom, which is expressed in the subject dimension of the right, it is no less important the objective aspect that it entails, because, by its realization is to achieve an effective limitation and control the exercise of public power by the European institutions. With regard to the constitutionality of the healthcare reformbibliuned:DerechoPolitico-2014-90-6020El presente artículo estudia el debate doctrinal y judicial sobre la constitucionalidad de la reforma sanitaria aprobada por el Congreso de los Estados Unidos. Concretamente, tras exponer cuáles son los fundamentos de esta reforma, este trabajo se va a centrar en los nuevos perfiles del federalismo cooperativo americano que se deducen de la interpretación que hace la Corte Suprema en National Federation of Independent Business v. Sibelius, de tres cláusulas clave en la evolución del modelo de distribución territorial del poder en los Estados Unidos de América: la Commerce Clause, la Necessary and Proper Clause y la Spending and Taxing Clause. Este estudio también se aproximará al debate surgido en torno a cuál ha de ser el nivel de deferencia hacia el legislador por parte de los jueces, a la hora de aplicar las reglas del poder territorial en el juicio de constitucionalidad de determinadas leyes de especial significación democrática. Para finalizar, también se analizará, a la luz de las objeciones libertarias vertidas contra la reforma, cómo progresivamente las categorías del federalismo desplazan a las del Bill of Righs en la defensa de ciertas libertades económicas frente a determinados programas sociales federales.This article studies the doctrinal and judicial debate on the constitutionality of the Health Care Reform passed by the U. S. Congress. After exposing the foundations of the reform, the article focuses on the new profiles of the American cooperative federalism that stem from the interpretation that the Supreme Court has done in the National Federation of Independent Business v. Sibelius of three key clauses for the evolution of the territorial distribution of powers in the U. S. A: the Commerce Clause, the Necessary and Proper Clause and the Spending and Taxing Clause. Furthermore, this article reflects on which should be the degree of deference of judges to the legislator when it comes to enforce the rules of territorial power in judging the constitutionality of laws with particular democratic relevance. Para analizar la evolución de dicha jurisprudencia, he utilizado los documentos del TEDH en versión original (www.echr.coe.int) y consultado el Derecho interno relevante, así como bibliografía sobre el TEDH y los derechos LGTBI.
El texto se divide en seis apartados, incluyendo la introducción (primer epígrafe) y la bibliografía.
En el segundo epígrafe se comenta la jurisprudencia del TEDH sobre orientación sexual y Derecho Penal. El primer problema que analiza el Tribunal es la tipificación de las relaciones homosexuales en el Reino Unido, la República de Irlanda y Chipre. La prohibición fue declarada contraria al Convenio y las leyes modificadas. No obstante, algunos Estados mantuvieron la prohibición para los miembros del ejército y varias personas acudieron al Tribunal, que declaró violado el Convenio. Otro problema es el de la edad de consentimiento para las relaciones sexuales, en algunos países más elevada para las parejas del mismo sexo que para las de diferente; el Tribunal declaró esta distinción discriminatoria.
El objeto del tercer apartado es la jurisprudencia en materia de orientación sexual y vida familiar, comenzando con el matrimonio y otras formas de reconocimiento jurídico de las relaciones estables entre personas del mismo sexo y estudiando también asuntos relativos a la filiación. En estas Sentencias, la principal cuestión es si hubo violación de los arts. 8 y 14 CEDH. Puede apreciarse una evolución en las respuestas del Tribunal, según el cual el margen de apreciación de los Estados es aún importante pero los poderes públicos deben tener en cuenta que las diferencias basadas en el sexo o la orientación sexual requieren razones particularmente serias para justificarse. Dado que estos casos son muy recientes y hay algunos pendientes, no puede decirse que la opinión del TEDH en esta materia sea definitiva.
Se estudian también otros asuntos relevantes, en los que el TEDH analiza la eventual discriminación basada en la orientación sexual en relación con los arts. 3 (prohibición de la tortura y los tratos o penas inhumanos o degradantes), 10 (libertad de expresión) y 11 (libertad de reunión y asociación) del CEDH.
Las principales conclusiones alcanzadas al final del trabajo pueden resumirse así. En primer lugar, la tipificación de las relaciones homosexuales viola el derecho a la vida privada. Además, las diferencias basadas en la orientación sexual requieren razones especialmente serias para no ser discriminatorias. Por otro lado, el Tribunal declara que las parejas del mismo sexo necesitan, igual que las de distinto, reconocimiento y protección legales. Respecto a la filiación, se analiza cada caso concediendo a los Estados cierto margen de apreciación pero dentro de límites reducidos.The object of this work is to study the European Court of Human Rights case-law concerning sexual orientation, used by the Spanish Constitutional Court (STC 198/2012, 6 November) to consider the Constitution as a living instrument which has to be interpreted in present-day conditions and, consequently, say that Article 32.1 of the Constitution must be interpreted as not excluding same-sex marriage.
To analyze the evolution of the mentioned case-law, I have used the official documents of the ECHR in their original version (www.echr.coe.int). In addition, I have consulted the relevant domestic Law when it has been necessary as well as some bibliography about ECHR and LGBTI rights.
The paper is divided into six sections, including introduction (first epigraph) and bibliography.
The second epigraph is about the ECHR case-law on sexual orientation and Criminal Law. The first problem analyzed by the Court is the criminalization of homosexual relations in the United Kingdom, the Republic of Ireland and Cyprus. The ban was found contrary to the Convention and laws were modified. However, certain of those States maintained the interdiction for the members of the army and several people went before the Court, who declared de Convention violated. Another problem in which Criminal Law is involved is that of the age of consent for sexual relations, which in some domestic Law is higher for same-sex couples than for different-sex ones; the Court found this distinction discriminatory.
The object of the third section is the ECHR case-law on sexual orientation and family life, starting with marriage and other forms of legal recognition of stable same-sex couples and also studying cases related to filiation. In this group of judgments, the main question answered by the Court is whether there has been a violation of Articles 8 and 14 of the Convention. An evolution can be seen in its responses, according to which the margin of appreciation of the States is still important, although public authorities have to take into account that differences based on sex or sexual orientation require particularly serious reasons by way of justification. As these cases are very recent and there are some pending, the opinion of the Court on this issue cannot be said to be definitive.
Afterwards, other relevant cases are studied, in which the ECHR analyzes the alleged discrimination based on sexual orientation in connection with Articles 3 (prohibition of torture and inhuman or degrading treatment or punishment), 10 (freedom of expression) and 11 (freedom of assembly and association) of the Convention.
The main conclusions reached at the end of the work can be summarized as follows. First of all, criminalization of homosexual relations violates the right to respect for private life. In addition, differences based on sexual orientation need especially serious reasons not to be discriminatory. Moreover, the Court declares that same-sex couples need for legal recognition and protection as well as different-sex ones.
