involuntarios y urgentes por trastorno mental como un supuesto de
limitación de derechos fundamentales (especialmente, libertad personal);
y, en particular, a la vista de la doctrina contenida en la Sentencia del
Tribunal Constitucional 141/2012, dictada en resolución de un recurso
de amparo al respecto. En tal sentido, se analiza el marco normativo de
dichos internamientos (distinguiendo entre el estrictamente constitucional,
el internacional y el meramente legal), su naturaleza (en relación
al internamiento como tal, como respecto a la intervención judicial que
ha de autorizarlo), sus concretas garantías (en especial, a la vista de la
STC 141/2012), así como diversas cuestiones abiertas por la anterior
Sentencia, no obstante, y que requieren de oportuna respuesta legal.The following piece of paper deals with the constitutional rule of
the involuntary and urgent confinements due to mental disorder as
restricting fundamental rights (especially, personal liberty) according
to the principles established in the judgement of the Spanish Constitutional

In 1983 the so-called “Miró Decree” was enacted. It offered generous measures to promote film production and establish a solid framework for the industry. At the same time, regional governments issued laws to boost the cinema. Both initiatives enabled debut directors to make more committed and personal films. Our work analyses the impact of this legislation on the films that addressed the dramatic theme of ETA terrorism; films that could be made thanks to committed support from central and regional governments. It also looks into how these projects were accepted by Spanish society. The films share common elements such as the way the directors distance themselves from displaying a heroic image of terrorists or a one-dimensional point of view on the Spanish police, while passing judgement on the social and economical crisis that coincided with the beginning of the Transition to democracy. Only four out of the twelve films shot during those six years did well at the box office, tripling their official costs. Los autores, previa exposición de lo que a su juicio son la contingencia infocomunicacional y tecnocultural del espacio y del tiempo, así como del discurso teórico y dialéctico que fundamenta el trabajo, presentan un estudio multivariante realizado en una muestra de estudiantes de la Universidad de Salamanca. Los resultados más relevantes de este análisis constatan que las diferencias significativas más destacadas están en las variables que hacen referencia a la percepción espacio-temporal asociadas a la idea de movimiento en el tiempo y a la noción de continuidad en el espacio.Based on the interest aroused by the characteristics of info-communications society and the network in the world of Social Education, we present the results of an investigation whose aim has been show the space-time dimensionality in the network. For that end, the authors’ previous exposition to what in their judgement is the info communications and technocultural contingency of space and time, as well as the theoretical and dialectic
discourse that underlies the work, present a multivariate and discriminant analysis conducted with a sample of Salamanca University students. The major purpose of the research is to uncover, explain and illustrate the type of violence which lies behind Jackson’s Female Gothic, a violence suffered by women because of their female condition and invisible due to its naturalisation and its dissolution under the spell of the feminine mystique. Pierre Bourdieu’s concept of symbolic violence as the kind of surreptitious violence exercised through everyday actions permeates Jackson’s Female Gothic. This genre, which has been traditionally used to defy the hegemonic patriarchal discourse, is used by the author to highlight the terrifying about the ordinary and to expose the oppression felt by the middle-class woman of the 40s and 50s. With this aim, Jackson draws on classic conventions, which she adapts to the context of the post-war America, where women’s fulfilment was defined by the feminine mystique which Betty Friedan exposed years later. However, she also creates new ones, such as the trope of the demon lover, recurrent in Jackson’s fiction. This thesis analyses the use of the tropes and connects them to the notion of symbolic violence proposed by Bourdieu. In the works analysed, this violence has been recognised as mockery, belittling, disregard, denigration, silencing, complicity, condescension, value judgements, social pressure and even metaphorical killing through erasure. In addition to Bourdieu’s principles, Marie-France Hirigoyen’s paradigm about psychological violence have been employed to illustrate the inclusion of this type of violence in some of the tales. Finally, all the female characters are divided according to their reactions to masculine domination. In one group, the protagonists accept their role and the consequent passivity and submission. The alternative response is to live outside the symbolic order in a permanent distressful state. Ni Jesús ni Muhammad quisieron crear una religión, sino corregir la primitiva revelación, que se había desviado. Muhammad ha creado una religiosidad que ha dado alimento espiritual durante muchos siglos a millones de fieles, y una mística fabulosa que ha durado más de 1.000 años. Tor Andrae señala influjos de la iglesia y del monacato sirio. D.J. Sahas indica influjo fuerte del monacato sirio en el Corán. Se comparan en este trabajo puntos fundamentales de la religiosidad del Corán con el del monacato palestino: infierno, Juicio Final, Demonología, Angeología, el Paraíso, Oración, Ayunos, Limosna, prohibición de alimento, Eucaristía, etc. Muhammad es un hereje cristiano para S. Juan Damasceno, que vivió muchos años en la corte de los Omeyas y desempeñó altos cargos. Muhammad admite que Cristo es el Mesías, un grandísimo profeta, la palabra de Dios y el enviado de Dios. Niega que sea Dios, ni la redención, ni la crucifixión, que es sólo aparente; acepta la resurrección y la subida a los cielos. No admite la Trinidad. Los grandes investigadores protestantes, Harnack, Schlatter, Wellhausen, en el siglo XX, afirman que era un ebionita, o sea, un judeo-cristiano heterodoxo, que vivían en Palestina y Siria, tesis que aceptó el gran teólogo católico H. Küng, partidario de un diálogo con el Islam. Muhammad llevó, al principio, una vida en la montaña, muy parecida a la de los monjes cristianos. En el arte musulmán hay pinturas que representan a Muhammad con monjes que él conocía de sus viajes a Siria. No se puede dudar de un fuerte influjo del monacato palestino y sirio en la religiosidad de Muhammad, como indica D.J. Sahas, excelente conocedor de S. Juan Damasceno. La religiosidad de Muhammad, del monacato palestino y de Jesús, tienen un fuerte carácter social, al igual que la de los grandes profetas de Israel. El presente estudio confirma la frase de Seyyed Husseyn Nasr, de que los primitivos musulmanes son monjes que no guardan el celibato.The great religious geniuses are Jesus, Buddha and Muhammad. Neither Jesus nor Muhammad wanted to create a religion, but to correct the primitive revelation, which had gotten off course. Muhammad has created a religiousness that has given millions of faithful spiritual food throughout many centuries and a fabulous mysticism that has lasted for over thousand years. Tor Andrae points out influences of the Syrian church and Monasticism. D.J. Sahas points out a strong Syrian Monasticism influence in the Qur’an. This paper compares fundamental aspects of religiousness in the Qur’an with that of Palestinian Monasticsm: Hell, Last Judgement, Demonology, Angeology, Paradise, Prayer, fasting, Alms, Food prohibition, Eucharist, etc. Muhammad is a Christian heretic according to Saint John of Damascus, who lived many years in the Umayyad court, where he held important posts. Muhammad admits that Christ is the Messiah, a great Prophet, the Word of God and his envoy. He denies he is God, as well as redemption, and crucifixion, which is only apparent, but accepts resurrection and ascension. He does not admit Trinity. The great protestant investigators of the 20th century –Harnack, Schlatter, Wellhausen– maintain he was an Ebionite, in other words, a heterodox Jewish Christian, who lived in Palestine and Syria. A thesis accepted by the great Catholic Theologian H. Küng, a supporter of dialogue with Islam. Muhammad lived at the beginning a mountain life, very similar to that of Christian monks. There are paintings in Muslim art depicting Muhammad with monks, who he knew well from his journeys to Syria. A strong influence of Palestinian and Syrian Monasticism in Muhammad’s religiousness can not be put in question, as D.J. Sahas, an excellent connisseur of Saint John of Damascus and Muhammad, points out. The religiousness of Muhammad, of Palestinian Monasticism and of Jesus have strong social character, like that of the great prophets of Israel.
