Todo ser humano tendrá el derecho a la vida y a la dignidad humana; la vida embrionaria y fetal estará sujeta a protección desde el momento de la concepción.». Es evidente que, a diferencia del texto constitucional anterior, se menciona expresamente la vida fetal y embrionaria, al igual que de modo también expreso se preceptúa que gozará de protección desde el momento de la concepción. Esta nueva regulación constitucional estaría para algunos, no estrictamente ampliando los titulares del derecho a la vida, pero sí al menos extendiendo el manto protector de la Constitución a la vida fetal y embrionaria desde su comienzo, lo que tendría por consecuencia excluir de plano la posibilidad de abortar legalmente en cualquier supuesto a voluntad de la mujer, suponiendo ello una ausencia de garantía para otros derechos fundamentales en juego de la madre.
La controversia en torno al art. II no sólo ha estado centrada en el supuesto enfoque más restrictivo del nuevo texto constitucional hacia el aborto, sino que se ha extendido a la propia concepción de derecho de la dignidad humana, que para cierta doctrina ha recibido una configuración distinta a la concepción predominante en el derecho europeo. Under Article II of Hungarian Basic Law «Human dignity shall be inviolable. Every human being shall have the right to life and human dignity; embryonic and foetal life shall be subject to protection from the moment of conception». It is evident that, unlike the previous Constitution, the Basic Law expressly mentions the fetal and embryonic life, as also expressly stipulates that it shall be protected from the moment of conception. This new constitutional provision would be for some scholars, not strictly expanding the holders of the right to life, but at least extending the protective cloak of the Constitution to fetal and embryonic life from its beginning, which would effectively exclude outright the possibility of legal abortion at discretion of woman in any event, implying an absence of constitutional guarantee for other mother’s fundamental rights at stake.
The controversy about art. This project addresses how perceptions of economic inequality and unfairness in the distribution of resources can influence individuals’ perceptions of dehumanization and self-objectification, and trigger detrimental consequences in theworkplace.Using two correlational surveys in different cultural contexts (N=748), and two experimental studies (N = 662), this research consistently shows that both high inequality and high unfairness perceptions decrease job satisfaction and dignity at work through dehumanization processes. Specifically, both inequality and unfairness increase perceived organizational dehumanization, which in turn increases participants’ self-objectification. Self-objectification is associated with lower job satisfaction and dignity at work. Hasta ahora, la protección de estos valores fundamentales se encuentra en el mecanismo previsto en el Art. 7 del TUE. La existencia de este mecanismo no ha logrado, sin embargo, evitar la vulneración de los valores fundamentales de la UE por parte de varios de sus Estados miembros. En este sentido, este trabajo propone la formulación de un nuevo mecanismo —«mecanismo de Copenhague»— que sea capaz de hacer un seguimiento permanente de la actuación de los Estados para evitar que se produzcan esas vulneraciones, pero que sea capaz también de imponer las sanciones más graves a las vulneraciones de estos valores fundamentales, incluida la expulsión de la UE.The UE is founded on a set of values which are mentioned in an explicit manner in Art. 2 of the TEU: respect for human dignity, freedom, democracy, equality, the rule of law and respect for human rights. Values which the same article states that are common to the Member States. Until now, the protection of these fundamental values is based on the mechanism foreseen in Art. 7 of the TEU. The existence of this mechanism though has not prevented the violation of these fundamental values by several of the Member States from taking place.
