Therefore the positions of EU New Member States Constitutional or Supreme Courts are analysed in the paper with the use of the multilevel constitutionalism theoretical approach and focus on changes introduced by the Lisbon Treaty, that opened a new constitutional horizon in the EU integration process. The European Court of Justice (ECJ) defined relations between EU law and national law thanks to the primacy principle of EU law. Nevertheless the EU law’s formal authority does not depend exclusively on ECJ position. It is conditioned largely by characteristics of each national legal system and national supreme or constitutional court case law. In fact, in most of EU Member States, certain constitutional reserves or constitutional limits to the primacy of EU law in the constitutional and supreme court case law with regard to (constitutional) fundamental rights and principles, can be found. Debido a la similitud de cultural, histórico y de la legalidad parece ser útil para analizar la situación legal en Polonia, la República Checa, Eslovaquia y Hungría. Due to the similarity of cultural, historical and legality seems to be useful to analyzethe legal situation in Poland, the Czech Republic, Slovakia and Hungary. The study shows that the constitution in so far as they relate to the acts of secondary EU law in the national legal system may raise some confusion. In Poland and Slovakia the constitutions guarantee the primacy of the EU secondary law, however, they do not precise the relationship between those acts and the EU secondary law. In the Czech Republic the constitution does not relate to the acts created by the European Union. Both the State Theory and the Theory of the Constitution are to be only partially effective in defining an appropriate conceptual model to the new phenomenon of European integration. It speaks well of a new concept, that of «European constitutional League», which provides a common terminological and introduced into the Europe Union’s vision of constitutional law at different levels. It is increasingly difficult to differentiate when we are dealing with national issues and when community issues. Therefore, if we want to legitimize the role of the European Union, we will have to try to include the constitutional principles governing the Member States in this new level. La tesis principal de este artículo es que la mayor parte del contenido de la actual Ley Fundamental trae su causa, en realidad, en la anterior Constitución liberal democrática, a pesar de que retóricamente quiera vincularse a un historicismo cristiano conservador. Existen, de cualquier forma, ciertas deficiencias sustantivas en la nueva Ley Fundamental: el recorte de las competencias del Tribunal Constitucional, la destitución del Comisionado para la Protección de los Datos Personales y del Presidente del Tribunal Supremo, la atribución al jefe de la administración judicial y al fiscal general de la facultad de seleccionar ad hoc el tribunal llamado a resolver un procedimiento judicial, la posibilidad de emitir una sentencia a cadena perpetua y el uso exagerado de las leyes cardinales (orgánicas). Esto incluso quiebra principios generales del constitucionalismo o las obligaciones impuestas por el derecho comunitario y por el derecho internacional. Alguna de dichas deficiencias pueden ser solventadas a través de una interpretación creativa si el Tribunal Constitucional de Hungría aceptara esta tarea como guardián de los valores constitucionales europeos.On 18 April 2011 The Hungarian Parliament approved the country’s new Constitution, named the ‘Basic Law of Hungary’. Its transitory provisions were approved in a different act of the Parliament, on 30 December 2011. Both acts entered into force on 1 January 2012. The article’s main thesis is that most of the Basic Law’s content stems from the previous democratic liberal Constitution, but that the rhetoric has changed into a conservative Christian historicising one. There are, however, also some substantive deficiencies in the new Basic Law, such as the curtailing of the competences of the Constitutional Court, the dismissal of the Data Protection Commissioner and of the President of the Supreme Court, the ability of the head of the judicial administration and of the Chief Prosecutor to choose a court for any court proceeding, the possibility of a lifelong prison sentence and the exaggerated use of cardinal (organic) laws. These either breach general principles of constitutionalism, or European Union and international law obligations. Para analizar la evolución de dicha jurisprudencia, he utilizado los documentos del TEDH en versión original (www.echr.coe.int) y consultado el Derecho interno relevante, así como bibliografía sobre el TEDH y los derechos LGTBI.
El texto se divide en seis apartados, incluyendo la introducción (primer epígrafe) y la bibliografía.
En el segundo epígrafe se comenta la jurisprudencia del TEDH sobre orientación sexual y Derecho Penal. El primer problema que analiza el Tribunal es la tipificación de las relaciones homosexuales en el Reino Unido, la República de Irlanda y Chipre. La prohibición fue declarada contraria al Convenio y las leyes modificadas. No obstante, algunos Estados mantuvieron la prohibición para los miembros del ejército y varias personas acudieron al Tribunal, que declaró violado el Convenio. Otro problema es el de la edad de consentimiento para las relaciones sexuales, en algunos países más elevada para las parejas del mismo sexo que para las de diferente; el Tribunal declaró esta distinción discriminatoria.
El objeto del tercer apartado es la jurisprudencia en materia de orientación sexual y vida familiar, comenzando con el matrimonio y otras formas de reconocimiento jurídico de las relaciones estables entre personas del mismo sexo y estudiando también asuntos relativos a la filiación. En estas Sentencias, la principal cuestión es si hubo violación de los arts. 8 y 14 CEDH. Puede apreciarse una evolución en las respuestas del Tribunal, según el cual el margen de apreciación de los Estados es aún importante pero los poderes públicos deben tener en cuenta que las diferencias basadas en el sexo o la orientación sexual requieren razones particularmente serias para justificarse. Dado que estos casos son muy recientes y hay algunos pendientes, no puede decirse que la opinión del TEDH en esta materia sea definitiva.
Se estudian también otros asuntos relevantes, en los que el TEDH analiza la eventual discriminación basada en la orientación sexual en relación con los arts. 3 (prohibición de la tortura y los tratos o penas inhumanos o degradantes), 10 (libertad de expresión) y 11 (libertad de reunión y asociación) del CEDH.
Las principales conclusiones alcanzadas al final del trabajo pueden resumirse así. En primer lugar, la tipificación de las relaciones homosexuales viola el derecho a la vida privada. Además, las diferencias basadas en la orientación sexual requieren razones especialmente serias para no ser discriminatorias. Por otro lado, el Tribunal declara que las parejas del mismo sexo necesitan, igual que las de distinto, reconocimiento y protección legales. Respecto a la filiación, se analiza cada caso concediendo a los Estados cierto margen de apreciación pero dentro de límites reducidos.The object of this work is to study the European Court of Human Rights case-law concerning sexual orientation, used by the Spanish Constitutional Court (STC 198/2012, 6 November) to consider the Constitution as a living instrument which has to be interpreted in present-day conditions and, consequently, say that Article 32.1 of the Constitution must be interpreted as not excluding same-sex marriage.
To analyze the evolution of the mentioned case-law, I have used the official documents of the ECHR in their original version (www.echr.coe.int). In addition, I have consulted the relevant domestic Law when it has been necessary as well as some bibliography about ECHR and LGBTI rights.
The paper is divided into six sections, including introduction (first epigraph) and bibliography.
The second epigraph is about the ECHR case-law on sexual orientation and Criminal Law. The first problem analyzed by the Court is the criminalization of homosexual relations in the United Kingdom, the Republic of Ireland and Cyprus. The ban was found contrary to the Convention and laws were modified. However, certain of those States maintained the interdiction for the members of the army and several people went before the Court, who declared de Convention violated. Another problem in which Criminal Law is involved is that of the age of consent for sexual relations, which in some domestic Law is higher for same-sex couples than for different-sex ones; the Court found this distinction discriminatory.
The object of the third section is the ECHR case-law on sexual orientation and family life, starting with marriage and other forms of legal recognition of stable same-sex couples and also studying cases related to filiation. In this group of judgments, the main question answered by the Court is whether there has been a violation of Articles 8 and 14 of the Convention. An evolution can be seen in its responses, according to which the margin of appreciation of the States is still important, although public authorities have to take into account that differences based on sex or sexual orientation require particularly serious reasons by way of justification. As these cases are very recent and there are some pending, the opinion of the Court on this issue cannot be said to be definitive.
Afterwards, other relevant cases are studied, in which the ECHR analyzes the alleged discrimination based on sexual orientation in connection with Articles 3 (prohibition of torture and inhuman or degrading treatment or punishment), 10 (freedom of expression) and 11 (freedom of assembly and association) of the Convention.
The main conclusions reached at the end of the work can be summarized as follows. First of all, criminalization of homosexual relations violates the right to respect for private life. In addition, differences based on sexual orientation need especially serious reasons not to be discriminatory. Moreover, the Court declares that same-sex couples need for legal recognition and protection as well as different-sex ones. Todo ser humano tendrá el derecho a la vida y a la dignidad humana; la vida embrionaria y fetal estará sujeta a protección desde el momento de la concepción.». Es evidente que, a diferencia del texto constitucional anterior, se menciona expresamente la vida fetal y embrionaria, al igual que de modo también expreso se preceptúa que gozará de protección desde el momento de la concepción. Esta nueva regulación constitucional estaría para algunos, no estrictamente ampliando los titulares del derecho a la vida, pero sí al menos extendiendo el manto protector de la Constitución a la vida fetal y embrionaria desde su comienzo, lo que tendría por consecuencia excluir de plano la posibilidad de abortar legalmente en cualquier supuesto a voluntad de la mujer, suponiendo ello una ausencia de garantía para otros derechos fundamentales en juego de la madre.
La controversia en torno al art. II no sólo ha estado centrada en el supuesto enfoque más restrictivo del nuevo texto constitucional hacia el aborto, sino que se ha extendido a la propia concepción de derecho de la dignidad humana, que para cierta doctrina ha recibido una configuración distinta a la concepción predominante en el derecho europeo. Under Article II of Hungarian Basic Law «Human dignity shall be inviolable. Every human being shall have the right to life and human dignity; embryonic and foetal life shall be subject to protection from the moment of conception». It is evident that, unlike the previous Constitution, the Basic Law expressly mentions the fetal and embryonic life, as also expressly stipulates that it shall be protected from the moment of conception. This new constitutional provision would be for some scholars, not strictly expanding the holders of the right to life, but at least extending the protective cloak of the Constitution to fetal and embryonic life from its beginning, which would effectively exclude outright the possibility of legal abortion at discretion of woman in any event, implying an absence of constitutional guarantee for other mother’s fundamental rights at stake.
The controversy about art. iniciativa popular caracteriza el régimen suizo en línea con su apuesta
por la utilización de mecanismos de democracia directa. Sin embargo,
la estrechez de los límites constitucionales impuestos a estas iniciativas
puede dar lugar a serias contradicciones entre el orden jurídico-político
interno y los compromisos internacionales asumidos por el país, lo que
resulta particularmente grave en lo que se refiere a los derechos humanos.
Así, la aprobación en 2009 de una nueva disposición constitucional
que prohíbe taxativamente la construcción de minaretes en la Federación
Helvética supone una fuente de conflictos normativos que parte
desde la posible violación de la libertad religiosa o el derecho a la no
discriminación, protegidos por las principales normas internacionales de
derechos humanos. En las condiciones actuales, hallar una solución estable
a esta suerte de contradicciones normativas resulta complicado, toda vez que la cultura política suiza es reacia tanto a ensanchar los límites de
la soberanía popular como a recibir correcciones de jueces extranjeros.
De este modo, se presentan por un lado una serie de problemas o dificultades
de orden jurídico y por otra parte, cuestiones de naturaleza
política. Entre las primeras, debe analizarse en primer lugar si una prohibición
de la construcción de minaretes en sede constitucional entraña
una violación de los derechos a la libertad religiosa o a la no discriminación
tal y como se recogen en normas internacionales, especialmente
el Convenio Europeo de Derechos Humanos. Respecto a este mismo
punto, cabe estudiar el acceso al Tribunal Europeo de Derechos Humanos
como garante de dicho convenio contra la disposición constitucional
suiza o las decisiones tomadas en aplicación de la misma. En segundo
lugar, es preciso estudiar los conflictos que pueden producirse en el
orden suizo entre normas constitucionales y normas internacionales, así
como plantear posibles soluciones a las mismas. Por lo que se refiere a las cuestiones de orden político, su análisis
deviene relevante para contextualizar adecuadamente las dificultades
jurídicas explicadas. En primera instancia, es conveniente estudiar el
significado del referéndum planteado en 2009 respecto de la construcción
de nuevos minaretes en un país que apenas cuenta con cuatro de
estas construcciones. La cultura política tradicional de Suiza ayuda en
este sentido a entender las dificultades de articulación entre la democracia
directa y un posible control jurídico internacional, así como la
relativa ausencia de controles internos, en sede judicial o parlamentaria
de las iniciativas populares. El peculiar modelo suizo se presenta
así problemático en un contexto de armonización europea sobre la
base de un marco común de protección de derechos humanos.
El análisis conduce a resaltar la necesidad de ensanchar los filtros de
admisión de iniciativas populares, reinterpretando el concepto de
normas imperativas de Derecho internacional a fin de incluir en las
mismas los elementos de los derechos humanos que pueden constituir
hoy en día parte de un acervo europeo común.The option to approve by referendum constitutional amendments proposed
by popular initiatives is one of the characteristic of the Swiss regime,
which fosters the use of direct democracy mechanisms. However,
the narrowness of the constitutional limits to this kind of initiatives
may open the door to serious contradictions between the domestic legal
order and those international commitments undertaken by the country,
being this particularly relevant in respect of human rights protection.
Thus, the approval in 2009 of a new constitutional clause banning the construction of minarets in the Helvetic Federation entails a set of legal
questions, starting from the possible violation of the religious freedom
or the right not to be discriminated against, both protected by the
highest international norms on human rights. Within the current conditions,
finding an stable solution to these legal inconsistencies seems
difficult, being the Swiss political culture reluctant to enlarge the limits
of the popular sovereignty and to receive mandates from foreign judges.
In this way, we face on the one hand problems or difficulties in the legal
field and, on the other hand, questions of a political nature. Among
the former, it must be firstly analysed whether the ban for construction
of new minarets at the Constitution entails per se a violation freedom of
religion or the right not to be discriminated against, in the way these
rights are understood in the main international human rights instrument,
such as the European Convention of Human Rights. In relation
to the same point, it is also possible to study the access to the European
Court of Human Rights as legal guarantee of the aforementioned treaty,
appealing against the constitutional clause or against the possible
decisions taken in its implementation. Secondly, it is necessary to reflect
about the conflicts that may arise at the Swiss legal order between
constitutional dispositions and international norms, as well as look for
possible solutions to these inconsistencies. As for the political aspects, their analysis becomes relevant to rightly
contextualize the aforementioned legal difficulties. Firstly, it is
necessary to reflect about the real meaning of the 2009 referendum
in a country where no more than four minarets can be found. The
traditional political culture of Switzerland helps in this respect to
understand the difficulties to put together direct democracy and
international legal controls, or the absence of parliament or judicial
domestic controls for popular initiatives. The peculiar Swiss model is
thus a problematic one in a context of European harmonisation on the
basis of a common framework of human rights protection.
The analysis brings us to underline the need to enlarge the admission
filters of the popular initiatives, adopting a new interpretation of the
concept of peremptory norms of international law, with the aim of
including in it those elements of human rights that constitute today

It is suggested that the regulation of such rights under Spanish Law of Asylum 12/2009 it provides a restrictive and conditioned acknowledgement and introduces explicitly discriminatory elements. Furthermore, it is defended that, against current practice of national Administration, grave discriminatory acts in the access and enjoyment of social rights may constitute the objective element of persecution. Secondly, main procedural guarantees and reception conditions for LGBTI asylum-seekers are studied, under new asylum package approved by the European Union in June 2013. fundamentales la Propuesta de reforma de la Ley Orgánica del
Poder Judicial elaborada por la Comisión institucional creada por
Acuerdo del Consejo de Ministros de 2 marzo 2012, Propuesta hecha
pública en febrero de 2013, se repasan las cuestiones que plantea en la
actualidad la ordenación procesal de los referidos derechos en España.
Las dos reformas que presenta la Propuesta en el ámbito que interesa
son: el establecimiento de un procedimiento para garantizar la
ejecución de las Sentencias TEDH en España y la desaparición de un
mecanismo procesal que se había establecido en 2007 («nulidad de actuaciones
»). Lo primero se valora positivamente, si bien se señala que
acaso haya que reformar también la Ley Orgánica del Tribunal Constitucional
(LOTC). Lo segundo también se valora favorablemente, pero
se considera que exige establecer algunas garantías adicionales más
efectivas, como serían Salas especializadas en los Tribunales Superiores
de Justicia y una Sala del mismo carácter en el Tribunal Supremo.
También se recomienda que se aplique más literalmente el requisito
que establece la LOTC de invocar el derecho fundamental tan pronto
como el mismo es vulnerado, pues ello a la larga mejoraría el conocimiento
de los derechos.
In this paper, while discussing the regulation of fundamental rights
in the Proposal of Ammendment of the Judicial Branch Act, drafted
by the Institutional Committee established by resolution of the
Council of Ministers of March 2, 2012, Proposal issued in February 2013, we review the issues raised in the field of the procedural
management of fundamental rights in Spain.
The two proposed reforms in the area of our interest are: the establishment
of a procedure to guarantee the effectiveness of the
European Court Judgments in Spain and the disappearance of a
procedural mechanism that was established in 2007 («nulidad de
actuaciones»/«annulment of the procedures»). The former is welcome,
though the fact that perhaps it is also necessary to reform the Organic
Law of the Spanish Constitutional Court (Constitutional Court
Organization Act, LOTC hereinafter) is suggested. The latter is also
positively valued, but the establishment of additional guarantees,
such as specialized Chambers in High Courts of the Autonomous
Communities and a Chamber of the same type in the Supreme Court
is considered necessary.
A more literal application of the LOTC requirement of the invocation
of the right as soon as it has been violated is also suggested which

Italian and Spanish families in a comparative perspectivebibliuned:23034This article analyses family changes in Italy and Spain from 1960 to 1990 and contrasts them with four Central/Northern European countries. Italy and Spain show extremely rapid family changes, which nevertheless do not lead to a convergence between southern and central/northern families. The particularities of the southern family model are a high degree of cross-generational cohabitation, a high frequency of social contacts and help within kinship, a strong institutionalization of marriage, a low female employment rate in the formal labour market, a low fertility rate, and widespread family and child-oriented attitudes. In addition, relations between generations are seen more in terms of obligations than in terms of individual choice. We conclude that the specific economic situation, the particularities of social policies and the family culture in Italy and Spain are important barriers for a further individualization of family relations in these societies. The aim of this paper is to analyse Italy and Spain as representatives of a Mediterranean type of society. The question whether such a type exists with respect to family changes will be explored here. For this purpose we use a comparative perspective. Our assumption is that the division of labour between state, family, labour market and church in Mediterranean countries is a specific one. The societal configuration in the South will be analysed from the perspective of the family. First, we will describe differences in demography and family among countries as well as cultural differences observed by opinion surveys. Second, we will develop some hypotheses in order to explain the southern family characteristics, their interrelations and their relation to other institutions. To this end, we will concentrate on the possible effects that southern modernization processes, employment and unemployment trends, family laws, social policies and some historical and cultural peculiarities in Italy and Spain have on family patterns. In this paper the hypotheses will be put forward only in a preliminary way, without testing them. The socio-economic crisis that has affected all European countries since the mid-seventies has gradually produced a collective loss of faith in the possibility of uninterrupted economic growth and disillusion concerning the programmes and promises of the welfare society. As a result of the crisis, the institutional framework began to change and the social division of responsibilities among the various institutional spheres, state, market and family, had to (and still has to) be re-negotiated (Flora 1985). In the new social and economic context, the interest in the family in the analysis of western-welfare society has become wider. From a cross-national perspective it is often assumed that southern welfare states have a different division of labour between state, market and family than other Northern/Central European societies (Ferrera 1994). Studies on this field show that, despite the development of the welfare state, the family and the ‘serving work’ (Balbo 1983) carried out by women in southern welfare societies have continued to constitute an indispensable resource for the satisfaction of many basic needs. The changing age structure of the population, the decreasing fertility rate and the emerging female employment patterns in Italy and Spain may affect the southern division of labour in an important way. While analysts are emphasizing the importance of the family for the satisfaction of many basic needs in this welfare state crisis period, the most “family-oriented” countries are moving towards a more individualistic society? Is this a contradiction? First of all, it needs to be determined to what extent the family is changing in the South and therefore we will give a general overview on these changes in the European context. Since 1965, in most European countries - with varying intensity and timing - a reduction in the fertility rate and an increase in the divorce rate has taken place. These new family behaviours have been related to the gradual diffusion of cohabitation and to the increase in births out of wedlock. During the 1970s these family changes became more radical in Scandinavia and more widespread in Central Europe, but they remained weak in Southern Europe. What was really new were the relations between sexes and generations. Equal opportunities became an important issue in public life (Roussel 1992), and changes in family roles also occurred. Muchos estudios han destacado que el uso de precedentes extranjeros (o «extrasistémicos») no se limita a los Tribunales nacionales, sino afecta también a los Tribunales internacionales. Todavía, es frecuente un abuso de la apelación de «dialogo judicial» para estas prácticas: además, faltan datos empíricos completos y normalmente se encuentran algunos ejemplos bastante casuales.
El artículo presenta los resultados de una investigación extensiva y completa sobre las decisiones de los dos Tribunales en los años 1987-2012, para verificar si verdaderamente hay algún dialogo entre los dos sistemas. La investigación sigue el método ya experimentado en estudios empíricos sobre el uso de precedentes extranjeros para los tribunales constitucionales, que está integrado al mismo tiempo para un análisis cuantitativo y cualitativo.
La investigación no muestra evidencias de un verdadero dialogo entre las dos instituciones, sino de una convergencia jurisprudencial en varias materias.The article aims to analyze the mutual references made in their judgments by the European Court of Human Rights and the Inter-american Court of Human Rights.
Previous studies on circulation of foreign precedents have been showing that the use of foreign or «extra-systemic» precedents is not a phenomenon limited to national courts, but does also affect international courts. Nontheless, the notion of «judicial dialogue» is often abused, and the interactions between courts are hardly proved through empirical data but rather through seldom examples.
The article presents the results of a general and systemic research on the case-law of the two courts in the period between 1987 and 2012, to verify if there is some kind of «judicial dialogue» or «cross-fertilization» between the two systems. The research follows the methodology previously applied in empirical studies on the use of foreign precedents by constitutional courts, which consists of both a quantitative and a qualitative analysis.
