En Hungría, por su parte, la ley de la UE se considera como una ley nacional, pero no elimina las dudas sobre la posibilidad de su control constitucional.The Visegrad Group’s countries joined the European Union more than 10 years ago, it’s a long time, enough to take in trying to assess the functioning of the acts created by the European Union in the constitutional courts of the new Member States. Due to the similarity of cultural, historical and legality seems to be useful to analyzethe legal situation in Poland, the Czech Republic, Slovakia and Hungary. The study shows that the constitution in so far as they relate to the acts of secondary EU law in the national legal system may raise some confusion. In Poland and Slovakia the constitutions guarantee the primacy of the EU secondary law, however, they do not precise the relationship between those acts and the EU secondary law. In the Czech Republic the constitution does not relate to the acts created by the European Union. limitación de derechos fundamentales (especialmente, libertad personal);

restricting fundamental rights (especially, personal liberty) according

Paraguay, por el que fue separado del cargo el Presidente Fernando
Lugo, estuvo marcado por la rapidez y la celeridad, lo que supuso
una supresión del pleno ejercicio del derecho de defensa por parte del
Presidente al haber sido destituido en tan solo 24 horas. En consecuencia,
el debate suscitado reside en determinar si el juicio político
es un verdadero juicio o proceso, si debe quedar amparado por el resto
de garantías constitucionales como el derecho de defensa y el debido
proceso, o si, por el contrario, al tratarse de una cuestión política, no
debe estar revestido de dichas garantías pudiendo la Cámara de Senadores
enjuiciar al Presidente de la República disponiendo libremente
los plazos y demás solemnidades en cada caso concreto y sin que haya
necesidad de acreditar las acusaciones que se formulan.
Para dirimir la cuestión, en el presente artículo se analiza la figura del juicio político tal y como está regulada en la Constitución paraguaya
y sus antecedentes, aportando algunos datos de Derecho comparado
—en concreto la regulación del juicio político en Argentina— y las
opiniones de la doctrina constitucionalista paraguaya sobre el contenido,
naturaleza y alcance del juicio político. Se establecen previamente
las nociones básicas acerca de la responsabilidad política y de los mecanismos
de control en los sistemas parlamentarios y presidencialistas,
resaltando sus diferencias esenciales, para posteriormente analizar, de
forma pormenorizada, cada una de las fases del juicio político que
terminó con la destitución de Lugo. También se estudian los medios de impugnación contra el juicio político
en el ordenamiento paraguayo, analizando detenidamente las resoluciones
de la Sala Constitucional de la Corte Suprema de Justicia dictadas
en las dos acciones de inconstitucionalidad que el Presidente interpuso:
una contra el reglamento que se dictó ex profeso para enjuiciarle, en la
que se denunciaba vulneración de la prohibición de lex praevia, derecho
de defensa y debido proceso; y otra contra la resolución de la Cámara de
Senadores (sentencia) que le condenó por mal desempeño de funciones y
le separó del cargo como Jefe de Estado y Jefe de Gobierno, en la que se
invocaron los mismos motivos constitucionales de fondo. Finalmente, se concluye con unas reflexiones sobre la naturaleza jurídica
del juicio político y, en concreto, sobre la constitucionalidad,
validez y legitimidad del juicio político al que fue sometido el Presidente,
concluyendo que no fue un juicio político en su verdadero significado
constitucional y que pudo verse alterada la libertad política al
destituir anticipadamente a un presidente democráticamente elegido,
aunque el proceso es plenamente válido y legítimo por cuanto que el
control de constitucionalidad ejercido por la Corte Suprema de Justicia
ha confirmado su correcto anclaje constitucional.The impeachment that took place in Paraguay on June 21st and
22nd, 2012, led to the removal from office of President Fernando
Lugo. It was marked by its speed and swiftness and resulted in the
suppression of the due process of law and the President’s right of defense
because of his dismissal within only 24 hours.
Consequently, the current debate is to determine if the impeachment
was a real trial or proceeding, with the required protection of constitutional
guarantees, or whether on the contrary, the impeachment
was political and should not be covered with such guarantees, allowing
the Senate to prosecute the President, establishing timeframes
and procedures for each case, without rightly accrediting the accusations that were formulated.
To resolve the question, this article analyzes the issue of impeachment
as established in the Paraguayan Constitution and its antecedents,
providing data of comparative law that regulates impeachment in Argentina,
and the opinions of Paraguayan constitutional doctrine about
the content, nature and scope of impeachment. Basic notions about
political responsibility, and control mechanisms in parliamentary and
presidential systems are established, highlighting their essential differences,
used later to analyze in detail each of the phases of impeachment
that ended with the removal of Fernando Lugo. This article also discusses the solutions against impeachment in the
Paraguayan system, carefully analyzing the two decisions of unconstitutionality
made by the Constitutional Chamber of the Supreme
Court: one against the regulation that was issued ex profeso prosecute
the president, in which he denounced violation of the prohibition of
lex praevia, right to defense and due process of the law; and the other
against the decision of the Senate that condemned him for malfeasance
and removed him as Head of State and Head of Government, in
which the same constitutional elements were invoked.
Finally, the article concludes with reflections on the legal nature of impeachment
and, in particular, on the constitutionality, validity and legitimacy
of the impeachment of the President, concluding that it was not
an impeachment in the true constitutional sense, and the political liberty
could have been altered by the early removal of a democratically elected
president, even though the process was evidently valid and legitimate,

imprenta durante la primera experiencia constitucional en España. En el
examen del contexto de su reconocimiento se observa que la libertad de
imprenta se alcanzó antes de facto que de iure, circunstancia que facilitó
enormemente la libre circulación de todo tipo de escritos y que, asimismo,
coadyuvó al intercambio de ideas sobre el nuevo modelo de Estado.
Del estudio de las principales razones que motivaron la aprobación
del Decreto de imprenta de 1810 se desprende que las Cortes no
concibieron la libertad de imprenta exclusivamente como un derecho
individual que posibilitaba el libre desarrollo de la personalidad sino
que, además, se trataba de un derecho llamado a desempeñar importantes
funciones en el nuevo modelo político que deseaban implantar.
Idea que corrobora el análisis del proceso constituyente y del funcionamiento
de las instituciones creadas por la Constitución de 1812.
Concretamente, en referencia al proceso constituyente, se observa que
con carácter previo a la aprobación de una Constitución digna de ser
calificada como racional-normativa, fue imprescindible reconocer y
garantizar la libertad de imprenta. Y, en relación al funcionamiento
de las nuevas instituciones liberales, la citada libertad pública era del
todo necesaria, dado que, entre otras cuestiones, posibilitó a los españoles
fiscalizar y controlar el ejercicio del poder político.Present contribution studies the role that freedom of the press fulfilled
during the first constitutional experience in Spain. Within the
study of the context of its recognition it is observed that Freedom of
the press was achieved before de facto rather than de iure. This circumstance
made possible the circulation of all kind of documents which
also contributed to the exchange of ideas about the new State model.
From the study of the main reasons that motivated the approval of the
Press Decree of 1810 can be inferred that Courts did not only conceive
Freedom of the press as a mere individual right that enabled the
free development of personality, but also as a right that was expected
to fulfill important functions in the new political model that was intended
to be established. This idea is corroborated by the analysis of
the constituent process and the work environment of the institutions
created in the 1812 Constitution. With reference to the constituent
process, it is observed that previous to the approval of a Constitution
that could be called as rational- regulatory, it was compulsory
to recognize and guarantee the Freedom of the press. Finally, and
related to the work environment of the new liberal institutions, the
aforementioned public liberty was entirely necessary as it allowed the
citizens the supervision and control of the political power’s exercise

Todo ser humano tendrá el derecho a la vida y a la dignidad humana; la vida embrionaria y fetal estará sujeta a protección desde el momento de la concepción.». Es evidente que, a diferencia del texto constitucional anterior, se menciona expresamente la vida fetal y embrionaria, al igual que de modo también expreso se preceptúa que gozará de protección desde el momento de la concepción. Esta nueva regulación constitucional estaría para algunos, no estrictamente ampliando los titulares del derecho a la vida, pero sí al menos extendiendo el manto protector de la Constitución a la vida fetal y embrionaria desde su comienzo, lo que tendría por consecuencia excluir de plano la posibilidad de abortar legalmente en cualquier supuesto a voluntad de la mujer, suponiendo ello una ausencia de garantía para otros derechos fundamentales en juego de la madre.
La controversia en torno al art. II no sólo ha estado centrada en el supuesto enfoque más restrictivo del nuevo texto constitucional hacia el aborto, sino que se ha extendido a la propia concepción de derecho de la dignidad humana, que para cierta doctrina ha recibido una configuración distinta a la concepción predominante en el derecho europeo. Under Article II of Hungarian Basic Law «Human dignity shall be inviolable. Every human being shall have the right to life and human dignity; embryonic and foetal life shall be subject to protection from the moment of conception». It is evident that, unlike the previous Constitution, the Basic Law expressly mentions the fetal and embryonic life, as also expressly stipulates that it shall be protected from the moment of conception. This new constitutional provision would be for some scholars, not strictly expanding the holders of the right to life, but at least extending the protective cloak of the Constitution to fetal and embryonic life from its beginning, which would effectively exclude outright the possibility of legal abortion at discretion of woman in any event, implying an absence of constitutional guarantee for other mother’s fundamental rights at stake.
The controversy about art. cierto protagonismo en el marco del Estado autonómico al ser esgrimido
como argumento para justificar algunas propuestas encaminadas
a afrontar los nuevos retos que plantea la crisis económica. Sin embargo,
aunque jurídicamente indeterminado, este concepto ni puede ser
identificado con cualquier circunstancia, ni tampoco puede dar cobertura
a cualquier medida. La Constitución ya plasmó el interés general
en la distribución de competencias efectuada en el Art. 149 CE en
favor del Estado y también previó que con carácter extraordinario se
pueda recurrir a él como presupuesto habilitante en los casos de aprobación
de leyes de armonización y de adopción de medidas de coerción
frente a incumplimientos autonómicos o a lesiones de ese mismo interés.
De la propia Constitución, en definitiva, cabe derivar quién, en
qué casos, con qué límites y con qué garantías ha de concretar un interés
general que, si bien se vincula al principio de unidad, tal y como
aparece configurado no puede prescindir del principio autonómico, en
tanto ambos son fundamento de nuestro modelo territorial. El interés
general es el interés del Estado entendido como un todo y por ello no puede ser ajeno a ninguna de las partes que lo componen.In recent times, the concept of general interest has become central
within the autonomous State’s framework as it has been put forward
as an argument to justify certain proposals designed to face the new
challenges brought by the economic crisis. However, although it is
legally undetermined, this concept cannot be identified whit just
any circumstance, nor can it cover any measure. The Constitution
has already reflected general interest in the power distribution set
in Article 149 CE in favour of the State, and also legislates that, in
extraordinary circumstances, it can be used to as an enabling precondition
in order to in cases which pass harmonization laws and adopt
coercion measures against autonomous non-compliance. The Constitution
itself also provides a source for deriving in which cases, with
what limits and with which guarantees general interest should be set.
Though this interest is linked to the principle of unity, the principle
of autonomy cannot be ignored. As the situation is set up now, both
principles are essential to our territorial structure. General interest
is the interest of the State understood as a whole, and, as a result, it

fundamentales la Propuesta de reforma de la Ley Orgánica del
Poder Judicial elaborada por la Comisión institucional creada por
Acuerdo del Consejo de Ministros de 2 marzo 2012, Propuesta hecha
pública en febrero de 2013, se repasan las cuestiones que plantea en la
actualidad la ordenación procesal de los referidos derechos en España.
Las dos reformas que presenta la Propuesta en el ámbito que interesa
son: el establecimiento de un procedimiento para garantizar la
ejecución de las Sentencias TEDH en España y la desaparición de un
mecanismo procesal que se había establecido en 2007 («nulidad de actuaciones
»). Lo primero se valora positivamente, si bien se señala que
acaso haya que reformar también la Ley Orgánica del Tribunal Constitucional
(LOTC). Lo segundo también se valora favorablemente, pero
se considera que exige establecer algunas garantías adicionales más
efectivas, como serían Salas especializadas en los Tribunales Superiores
de Justicia y una Sala del mismo carácter en el Tribunal Supremo.
También se recomienda que se aplique más literalmente el requisito
que establece la LOTC de invocar el derecho fundamental tan pronto
como el mismo es vulnerado, pues ello a la larga mejoraría el conocimiento
de los derechos.
In this paper, while discussing the regulation of fundamental rights
in the Proposal of Ammendment of the Judicial Branch Act, drafted
by the Institutional Committee established by resolution of the
Council of Ministers of March 2, 2012, Proposal issued in February 2013, we review the issues raised in the field of the procedural
management of fundamental rights in Spain.
The two proposed reforms in the area of our interest are: the establishment
of a procedure to guarantee the effectiveness of the
European Court Judgments in Spain and the disappearance of a
procedural mechanism that was established in 2007 («nulidad de
actuaciones»/«annulment of the procedures»). The former is welcome,
though the fact that perhaps it is also necessary to reform the Organic
Law of the Spanish Constitutional Court (Constitutional Court
Organization Act, LOTC hereinafter) is suggested. The latter is also
positively valued, but the establishment of additional guarantees,
such as specialized Chambers in High Courts of the Autonomous
Communities and a Chamber of the same type in the Supreme Court
is considered necessary.
A more literal application of the LOTC requirement of the invocation
of the right as soon as it has been violated is also suggested which

iniciativa popular caracteriza el régimen suizo en línea con su apuesta
por la utilización de mecanismos de democracia directa. Sin embargo,
la estrechez de los límites constitucionales impuestos a estas iniciativas
puede dar lugar a serias contradicciones entre el orden jurídico-político
interno y los compromisos internacionales asumidos por el país, lo que
resulta particularmente grave en lo que se refiere a los derechos humanos.
Así, la aprobación en 2009 de una nueva disposición constitucional
que prohíbe taxativamente la construcción de minaretes en la Federación
Helvética supone una fuente de conflictos normativos que parte
desde la posible violación de la libertad religiosa o el derecho a la no
discriminación, protegidos por las principales normas internacionales de
derechos humanos. En las condiciones actuales, hallar una solución estable
a esta suerte de contradicciones normativas resulta complicado, toda vez que la cultura política suiza es reacia tanto a ensanchar los límites de
la soberanía popular como a recibir correcciones de jueces extranjeros.
De este modo, se presentan por un lado una serie de problemas o dificultades
de orden jurídico y por otra parte, cuestiones de naturaleza
política. Entre las primeras, debe analizarse en primer lugar si una prohibición
de la construcción de minaretes en sede constitucional entraña
una violación de los derechos a la libertad religiosa o a la no discriminación
tal y como se recogen en normas internacionales, especialmente
el Convenio Europeo de Derechos Humanos. Respecto a este mismo
punto, cabe estudiar el acceso al Tribunal Europeo de Derechos Humanos
como garante de dicho convenio contra la disposición constitucional
suiza o las decisiones tomadas en aplicación de la misma. En segundo
lugar, es preciso estudiar los conflictos que pueden producirse en el
orden suizo entre normas constitucionales y normas internacionales, así
como plantear posibles soluciones a las mismas. Por lo que se refiere a las cuestiones de orden político, su análisis
deviene relevante para contextualizar adecuadamente las dificultades
jurídicas explicadas. En primera instancia, es conveniente estudiar el
significado del referéndum planteado en 2009 respecto de la construcción
de nuevos minaretes en un país que apenas cuenta con cuatro de
estas construcciones. La cultura política tradicional de Suiza ayuda en
este sentido a entender las dificultades de articulación entre la democracia
directa y un posible control jurídico internacional, así como la
relativa ausencia de controles internos, en sede judicial o parlamentaria
de las iniciativas populares. El peculiar modelo suizo se presenta
así problemático en un contexto de armonización europea sobre la
base de un marco común de protección de derechos humanos.
El análisis conduce a resaltar la necesidad de ensanchar los filtros de
admisión de iniciativas populares, reinterpretando el concepto de
normas imperativas de Derecho internacional a fin de incluir en las
mismas los elementos de los derechos humanos que pueden constituir
hoy en día parte de un acervo europeo común.The option to approve by referendum constitutional amendments proposed
by popular initiatives is one of the characteristic of the Swiss regime,
which fosters the use of direct democracy mechanisms. However,
the narrowness of the constitutional limits to this kind of initiatives
may open the door to serious contradictions between the domestic legal
order and those international commitments undertaken by the country,
being this particularly relevant in respect of human rights protection.
Thus, the approval in 2009 of a new constitutional clause banning the construction of minarets in the Helvetic Federation entails a set of legal
questions, starting from the possible violation of the religious freedom
or the right not to be discriminated against, both protected by the
highest international norms on human rights. Within the current conditions,
finding an stable solution to these legal inconsistencies seems
difficult, being the Swiss political culture reluctant to enlarge the limits
of the popular sovereignty and to receive mandates from foreign judges.
In this way, we face on the one hand problems or difficulties in the legal
field and, on the other hand, questions of a political nature. Among
the former, it must be firstly analysed whether the ban for construction
of new minarets at the Constitution entails per se a violation freedom of
religion or the right not to be discriminated against, in the way these
rights are understood in the main international human rights instrument,
such as the European Convention of Human Rights. In relation
to the same point, it is also possible to study the access to the European
Court of Human Rights as legal guarantee of the aforementioned treaty,
appealing against the constitutional clause or against the possible
decisions taken in its implementation. Secondly, it is necessary to reflect
about the conflicts that may arise at the Swiss legal order between
constitutional dispositions and international norms, as well as look for
possible solutions to these inconsistencies. As for the political aspects, their analysis becomes relevant to rightly
contextualize the aforementioned legal difficulties. Firstly, it is
necessary to reflect about the real meaning of the 2009 referendum
in a country where no more than four minarets can be found. The
traditional political culture of Switzerland helps in this respect to
understand the difficulties to put together direct democracy and
international legal controls, or the absence of parliament or judicial
domestic controls for popular initiatives. The peculiar Swiss model is
thus a problematic one in a context of European harmonisation on the
basis of a common framework of human rights protection.
The analysis brings us to underline the need to enlarge the admission
filters of the popular initiatives, adopting a new interpretation of the
concept of peremptory norms of international law, with the aim of
including in it those elements of human rights that constitute today

Sugiere que la regulación de este derecho en la Ley de Asilo 12/2009, de 30 de octubre, opera de forma restrictiva y condicionada e introduce elementos manifiestamente discriminatorios. Además, defiende que, en contra de la práctica de la Administración, los actos de discriminación grave en el acceso y ejercicio a los derechos sociales básicos también pueden constituir el elemento objetivo de persecución. En segundo término, introduce las principales garantías de procedimiento y condiciones de acogida que nuestro ordenamiento jurídico debe incorporar tras el paquete de asilo, aprobado en junio de 2013 por la Unión Europea, en relación con los solicitantes de asilo LGBTI. Por último, a la luz del estudio de la jurisprudencia española y europea, se cuestiona la coherencia y pertinencia en la exigencia de indicios suficientes para la prueba del relato y se rechaza el criterio de discreción desde el enfoque de los derechos humanos.This essay introduces a critical analysis on the legal content of the right to asylum on the grounds of sexual orientation and gender identity. It is suggested that the regulation of such rights under Spanish Law of Asylum 12/2009 it provides a restrictive and conditioned acknowledgement and introduces explicitly discriminatory elements. Furthermore, it is defended that, against current practice of national Administration, grave discriminatory acts in the access and enjoyment of social rights may constitute the objective element of persecution. Secondly, main procedural guarantees and reception conditions for LGBTI asylum-seekers are studied, under new asylum package approved by the European Union in June 2013.
