cierto protagonismo en el marco del Estado autonómico al ser esgrimido
como argumento para justificar algunas propuestas encaminadas
a afrontar los nuevos retos que plantea la crisis económica. Sin embargo,
aunque jurídicamente indeterminado, este concepto ni puede ser
identificado con cualquier circunstancia, ni tampoco puede dar cobertura
a cualquier medida. La Constitución ya plasmó el interés general
en la distribución de competencias efectuada en el Art. 149 CE en
favor del Estado y también previó que con carácter extraordinario se
pueda recurrir a él como presupuesto habilitante en los casos de aprobación
de leyes de armonización y de adopción de medidas de coerción
frente a incumplimientos autonómicos o a lesiones de ese mismo interés.
De la propia Constitución, en definitiva, cabe derivar quién, en
qué casos, con qué límites y con qué garantías ha de concretar un interés
general que, si bien se vincula al principio de unidad, tal y como
aparece configurado no puede prescindir del principio autonómico, en
tanto ambos son fundamento de nuestro modelo territorial. El interés
general es el interés del Estado entendido como un todo y por ello no puede ser ajeno a ninguna de las partes que lo componen.In recent times, the concept of general interest has become central
within the autonomous State’s framework as it has been put forward
as an argument to justify certain proposals designed to face the new
challenges brought by the economic crisis. However, although it is
legally undetermined, this concept cannot be identified whit just
any circumstance, nor can it cover any measure. The Constitution
has already reflected general interest in the power distribution set
in Article 149 CE in favour of the State, and also legislates that, in
extraordinary circumstances, it can be used to as an enabling precondition
in order to in cases which pass harmonization laws and adopt
coercion measures against autonomous non-compliance. The Constitution
itself also provides a source for deriving in which cases, with
what limits and with which guarantees general interest should be set.
Though this interest is linked to the principle of unity, the principle
of autonomy cannot be ignored. As the situation is set up now, both
principles are essential to our territorial structure. General interest
is the interest of the State understood as a whole, and, as a result, it

El principio de unidad jurisdiccional, entendido de una manera particularmente rígida, unido a una distribución competencial que, en el ámbito de la administración de justicia, parecía excluir a las CCAA, llevaban de modo inevitable a esa conclusión. Sin embargo, tanto los primeros estatutos como la LOPJ como, finalmente, las actuales reformas estatutarias, han intentado diferentes mecanismos de aproximación entre ambas realidades. La STC 31/2010 permite constatar cómo esos mecanismos tienen unos límites claros en la propia regulación constitucional, y pone de manifiesto que solo la reforma de ésta posibilitaría una verdadera adecuación entre Poder Judicial y modelo de Estado. El objeto de este artículo es ver en qué ámbitos puede darse tal adecuación, y qué opciones se abren en cada uno de ellos.The Constitution, while putting the basis for the political decentralization of the State, configured the Judiciary on a unitary model, so that the Judiciary and the model of State appeared to be two realities destined to ignore each other, and not seek any type of reciprocal influence. The principle of jurisdictional unity, understood in a particularly rigid way, linked with a distribution of powers in the field of administration of justice that seemed to exclude the Autonomous Communities, led inevitably to that conclusion. However, both statutes as LOPJ as the current statutory reforms have tried different mechanisms of rapprochement between the two realities. The STC 31/2010 shows how these mechanisms are clearly limited by the constitutional provisions; only a constitutional reform would allow a true adequacy between the Judiciary and the model of State. instrumentos jurídicos e institucionales que han vehiculizado la colaboración
horizontal. Proceso que cristalizó en la generalización de
los mismos, en un marco de afirmación de la estructura territorial
descentralizada de nuestro Estado, y que ha permitido dotar de mayor
normalidad a las relaciones intercomunitarias; ralentizadas, sin embargo,
en la actualidad, por la crisis económica.

The focus of this article is the relations between the Comunidades Autónomas
in Spain, as a paradigm of a decentralized State. The author
analyses the progressive evolution of this relations, including the
gradual development of the institutional and legal instruments that
have articulated the horizontal collaboration between the regions. The
generalization of these instruments consolidated the decentralized
territorial structure of Spain and contributed to the normalization of
the relations between the different regions, although this process has

En las últimas décadas, y a causa de distintos problemas, los organismos internacionales han tenido gran protagonismo en la regulación de la protección del menor y en el establecimiento de medidas para su ejecución. Los derechos establecidos para salvaguardarla han impulsado numerosos servicios sociales destinados a la protección del menor.
Las medidas desarrolladas por los organismos internacionales se han ido paulatinamente integrando en países europeos, como en España donde no solo existe legislación estatal, sino también prolijas legislaciones autonómicas. Se han elaborado numerosos Planes administrativos de intervención con vigencia plurianual, que han articulado un elenco amplio de prestaciones para la infancia. Sin duda, nos encontramos, ante uno de los servicios sociales con mayor dinamismo, debido a la constante mutación de sus necesidades de protección. El artículo analiza el impacto que la crisis está teniendo en la infancia y adolescencia, tanto como consecuencia de las situaciones familiares, o como resultado de las medidas de políticas públicas tomadas para enfrentarse a ella.
El estudio concluye destacando las consecuencias que supone no tener en cuenta el impacto en los niños, de las decisiones en políticas sociales, económicas, educativas, sanitarias y de no proteger adecuadamente a la infancia y sus derechos durante este difícil y complejo periodo de transformaciones sociales y económicas.The article examines the public policies for the Child, in the context of the social transformations that have recently emerged in this field. In the last decades, and due to various reasons, the international organizations have had great prominence in the regulation of the Child protection and in the establishment of measures for its execution. The rights established for the safeguard of the Child protection have driven numerous social services.
The measures developed by the International Organizations have been slowly assumed by European countries, such as Spain that not only has a State-level legislation, but also a prolix Autonomic-level one. Many Administrative Plans of Intervention have been elaborated with validity for several years and have articulated a wide range of benefits for Child. Without any doubt, we have one of the social services with a larger dynamism due to the constant changes of the need of protection.
The article analyzes the impact of the crisis in children and teenagers, as a consequence of family situations, or as a result of the public policies taken to face those situations.
