Debido a la similitud de cultural, histórico y de la legalidad parece ser útil para analizar la situación legal en Polonia, la República Checa, Eslovaquia y Hungría. El estudio muestra que la Constitución en la medida en que se refiere a los actos de Derecho derivado de la UE en el sistema jurídico nacional puede crear cierta confusión. En Polonia y Eslovaquia, las constituciones garantizan la primacía del Derecho derivado de la UE, sin embargo, no precisa la relación entre estos actos y el Derecho derivado de la UE. En la República Checa la Constitución no se refiere a las normas creadas por la Unión Europea. En Hungría, por su parte, la ley de la UE se considera como una ley nacional, pero no elimina las dudas sobre la posibilidad de su control constitucional.The Visegrad Group’s countries joined the European Union more than 10 years ago, it’s a long time, enough to take in trying to assess the functioning of the acts created by the European Union in the constitutional courts of the new Member States. Due to the similarity of cultural, historical and legality seems to be useful to analyzethe legal situation in Poland, the Czech Republic, Slovakia and Hungary. The study shows that the constitution in so far as they relate to the acts of secondary EU law in the national legal system may raise some confusion. In Poland and Slovakia the constitutions guarantee the primacy of the EU secondary law, however, they do not precise the relationship between those acts and the EU secondary law. In the Czech Republic the constitution does not relate to the acts created by the European Union. Frente a la convicción inquebrantable de los promotores de la independencia de que Escocia, tras la independencia, permanecerá en la UE, como Estado miembro de pleno derecho y que la modificación de un status es una cuestión interna, casi una mera formalidad, este trabajo analiza los problemas que plantea la pretención escocesa, en la UE, entre Derecho y Política.This paper’s aim is to analyze the effects the secession of territories in the Member States can have within the EU, regarding the hypothetical independence of Scotland in the case a majority of Scotish citizens would back that opinion in the referendum on September 18, 2014. Those who are promoting and independent Scotland are completely convinced that the territory will remain in the EU, as an independent Member State, and that it will reach this new status from within the EU. In their mind, that is an EU’s «internal» matter, which doesn’t need any special procedure, as far as it would be just little more than a formality. of the Charter, the right to a fair trial. It is not a new contribution of
the Charter but a guarantee which has been provided by EU Law for
decades. It first appeared as a procedural right, was later recognized
as a general principle of the EU and was finally embodied in the
Charter. Consequently this work recalls that process of recognition,
paying special attention to the judicial remedies provided by EU law
and to some specific rules of secondary —competition— law which
affect the context on which the right to a fair trial is developed. The
article concludes by underlining, on the one hand, the improvements
on the right to a fair trial brought about by this legal process and, on
the other hand, a few gaps on the issue which are neither recent nor
consistent with the effectiveness and completeness of such right as it
is required by the Rule of Law tradition.Este artículo se centra en uno de los derechos previstos por el artículo 47
de la Carta Europea de Derechos, el derecho a un juicio justo. No es una nueva aportación de la Carta, pues se trata de una garantía de que
ha sido proporcionada por la legislación de la UE durante décadas.
Primero apareció como un derecho procesal, más tarde fue reconocido
como un principio general de la Unión Europea y finalmente fue
incorporado a la Carta. Por lo tanto, este trabajo recuerda ese proceso
de reconocimiento, prestando especial atención a los recursos judiciales
de derecho de la UE y a algunas normas específicas de derecho
derivado que afectan al contexto en que se desarrolla el derecho a un
juicio justo. El artículo concluye subrayando, por un lado, las mejoras
sobre el derecho a un juicio justo provocado por este proceso legal y,
por otra parte, algunas lagunas en este ámbito que son ni recientes
ni compatibles con la eficacia y la integridad de ese derecho, como lo

The selection favours an institutional and constitutional approach to the jurisprudence of the Court, but some of the most important substantive judgments have also been included. Given limitations of space and length the presentation and comments on the judgments have not delved into the detailed facts of the cases, opting rather for the presentation of the ratio and the legal principles following from the judgments and showing how these have become «leading cases» of Union law, sometimes even gibing way to secondary legislation.
